🚨 New O-1A Updates from USCIS! 🚨 Exciting news for those pursuing the O-1A visa! USCIS has announced updates to the O-1A Policy Manual, and here’s what you need to know: 1. A Founder’s US Entity Can Act as a Petitioner: The policy now confirms that a company owned by the beneficiary can file an O-1A petition. The use of the term “owned” implies that the company can even be majority-owned (over 50%) by the beneficiary. This is fantastic news for startup founders! 2. Extended Stay Flexibility: If your ongoing project aligns with the original purpose of your O-1A visa and is within a similar area of expertise, you can now extend your visa in 3-year increments. This means more stability for professionals working on long-term projects! 3. Simplified Role Criteria: The definition of critical roles has been streamlined. Previously, terms like “Senior” were specified for qualifying positions, but now that restriction has been removed. 4. Broader Contribution Examples: The list of qualifying contributions has been expanded.
