Keller Postman LLC Celebrates Unanimous Victory for Plaintiffs at the U.S. Supreme Court Keller Postman LLC is proud to announce that it has secured a momentous victory for plaintiffs across the country: The U.S. Supreme Court unanimously affirmed the appellate court’s decision in Royal Canin U.S.A., Inc. v. Wullschleger, reconfirming that plaintiffs are the masters of their complaints. Specifically, Justice Kagan’s opinion makes clear that when a plaintiff removes all federal claims from her complaint, federal courts are not allowed to interfere with the plaintiff’s decision to have her case heard in state court. The Supreme Court also made clear that this principle is a jurisdictional rule, such that when a plaintiff amends her complaint to destroy the basis for removal jurisdiction, the district court has no discretion to keep the case but rather must remand the case back to state court. The Supreme Court’s decision marks a sharp break from past practice, where plaintiffs were stripped of authority to dictate their choice of forum, even if they eliminated all federal claims from their complaints. Keller Postman LLC Makes Second Argument Before the U.S. Supreme Court On the first day of the 2024 term, Keller Postman Co-Founder Ashley Keller made his second oral argument before the Supreme Court. Representing respondents in Royal Canin U.S.A. Inc. v. Wullschleger, Keller Postman defended the principle that a plaintiff is the master of her suit, such that amending out federal claims deprives federal courts of supplemental jurisdiction to adjudicate state-law claims. That rule, Keller Postman maintains, should apply in both original and removed cases. Appearing on Monday at counsel’s table was Associate Noah Heinz, who was instrumental in writing respondents’ brief on the merits and helping Ashley prepare for oral argument. A decision in the case is expected by June of 2025.

Keller Postman Achieves Landmark $1.4 Billion Settlement for Texas in Record Time Today, Keller Postman announces that Meta Platforms has agreed to pay $1.4 billion to the State of Texas for the company’s decade-long violations of the State’s biometrics-privacy law. This marks the largest settlement that a single State has ever achieved, and the largest privacy-related settlement by a State in American history. Senior Partner Zina Bash led the case alongside Attorney General Ken Paxton and First Assistant Brent Webster, with co-counsel from McKool Smith. Zina said of the settlement, “This was an unprecedented case in many ways: It was the first time the State of Texas sought to enforce its biometric-privacy law since enactment . . . And it was the first time a single State has ever achieved a settlement of this magnitude—which is even more rewarding because of the record time in which we obtained it.” Managing the litigation with Zina were Senior Counsel Nick Larry, Partner Jessica Beringer, and Senior Partner Ashley Keller. The case had been set to be tried to a jury in June by attorneys from Keller Postman, including Partner John James Snidow, and attorneys from McKool Smith.
