  • WHAT TO KNOW ABOUT RECORDING CONVERSATIONS WITHOUT CONSENT IN ARIZONA 🌵 Are you aware of Arizona's rules on recording conversations? It's important to understand these regulations to stay on the right side of the law. Arizona operates under a “one-party consent” rule, as defined by ARS § 13-3005. This means you can legally record a conversation if you're a participant or if you've obtained permission from one of the parties involved. But be cautious! 📢 Secretly recording a conversation you're not part of can lead to serious legal repercussions, including criminal charges. The penalties for such actions can be as severe as a Class 5 felony, which might land you in prison for up to 2.5 years for a first-time offense. Protecting privacy is paramount in Arizona, and it's crucial to remain informed about these legal boundaries. Need to dive deeper into the details? 🤓 Visit Kolsrud Law Offices for a comprehensive exploration of how these laws impact you, especially in legal situations. Two people were shot, one was stabbed, and a separate incident involving a man with firearms unfolded shortly after. These events have raised questions about airport security, legal consequences, and the investigation process.   Phoenix criminal defense attorney Josh Kolsrud of Kolsrud Law Offices joined Fox10 News to discuss the legal implications of the incidents and what comes next.   The Initial Altercation: A Complex Case On Christmas night, a violent altercation broke out in a public area of the airport, prior to the security checkpoint. According to Kolsrud, five individuals were involved in the incident, which included both a stabbing and a shooting.   “All indications suggest that the parties knew each other,” Kolsrud explained. “At some point, a teenager allegedly pulled a knife, and another individual responded by shooting three people. Airport security acted swiftly to apprehend everyone involved before they could escape.”   The incident now rests in the hands of prosecutors, who must determine whether any legitimate self-defense claims exist and uncover the motivations behind the fight.   The Legal Timeline High-profile cases like this often take time to unravel. Kolsrud noted that in Arizona, prosecutors have 48 hours to press charges when a suspect is in custody.   “If charges aren’t filed within that time frame, the suspects must be released,” Kolsrud said. “However, prosecutors and law enforcement still have up to seven years to decide if they have enough evidence to bring charges.”   The case’s location at an airport adds another layer of complexity, as federal charges and investigations could come into play. “The FBI will likely want to know why someone brought a firearm or a knife to the airport and whether there was any intent to breach security,” Kolsrud added.   A Separate Incident: Suicide by Cop Two hours after the initial altercation, a separate and equally troubling event occurred. A man, reportedly mentally distressed, arrived at the airport armed with three firearms.   “This individual mistakenly believed there was an active shooter at the airport and showed up with two handguns and a rifle,” Kolsrud explained. “But it wasn’t to help anyone—he wanted to commit suicide by cop.”   The man handed two of his weapons to a security… #InTheNews #gunlaws

  • Criminal Attorney Josh Kolsrud Talks with Phoenix 3TV About Deadly Wisconsin School Shooting Dec 19, 2024 - 3TV News, Phoenix Tragedy in Madison: A Deadly School Shooting Raises Questions About Gun Access and Parental Accountability The Madison, Wisconsin community is reeling in the aftermath of a tragic school shooting at a private Christian school that claimed the lives of two individuals and left several others injured. Authorities identified the shooter as 15-year-old Natalie Rupnow, who was found dead inside the school following the attack. This devastating event has reignited national conversations surrounding gun laws and the responsibilities of parents when minors gain access to firearms.   Josh Kolsrud, a Phoenix-based criminal defense attorney with Kolsrud Law Offices, joined 3TV Phoenix anchors to provide insight into the legal implications and potential accountability for the shooter’s parents.   Limited Information on Motive “At this point, the Madison Police Department has been tight-lipped about the possible motives behind this case,” Kolsrud noted. “They have yet to release a manifesto allegedly linked to Natalie Rupnow or provide details about her personal relationships that might have influenced her actions.”   Access to Firearms: A Critical Factor One pressing question is how Rupnow was able to access a firearm. “Prosecutors in cases like this always investigate how the shooter obtained the weapon,” Kolsrud explained.   He referenced two high-profile cases to illustrate potential legal outcomes:   Ethan Crumbley Case (Michigan): Crumbley’s parents were charged with negligent homicide for failing to securely store their handgun, marking the first instance of such charges in the United States. Colton Gray Case (Georgia): The shooter’s father faced charges of negligent homicide and second-degree murder after his failure to secure firearms.   “We’re all waiting to see if Wisconsin prosecutors will follow similar paths,” Kolsrud said. “In this case, social media evidence shows Rupnow using a 9mm handgun under her father’s supervision a few months ago. Investigators will need to determine if that was the same weapon used in the shooting and whether it was properly secured at home.”   Parental Liability Under Wisconsin Law Wisconsin does have child access prevention laws, but they only apply to children under the age of 14. Since Rupnow was 15, this law would not be applicable. However, Kolsrud pointed out that negligent homicide charges could still be pursued. “If prosecutors find evidence that her father provided the weapon or failed to store it properly, they could charge him with negligent homicide, following the precedent set in Michigan and Georgia,” he said.   Preventing Future Tragedies While accountability is crucial, Kolsrud emphasized the importance of prevention. “Locking up firearms can be an ounce of prevention that prevents immense tragedy,” he said.
