Phoenix criminal defense attorney Josh Kolsrud of Kolsrud Law Offices joined Fox10 News to discuss the legal implications of the incidents and what comes next. The Initial Altercation: A Complex Case On Christmas night, a violent altercation broke out in a public area of the airport, prior to the security checkpoint. According to Kolsrud, five individuals were involved in the incident, which included both a stabbing and a shooting. “All indications suggest that the parties knew each other,” Kolsrud explained. “At some point, a teenager allegedly pulled a knife, and another individual responded by shooting three people. Airport security acted swiftly to apprehend everyone involved before they could escape.” The incident now rests in the hands of prosecutors, who must determine whether any legitimate self-defense claims exist and uncover the motivations behind the fight. The Legal Timeline High-profile cases like this often take time to unravel. Kolsrud noted that in Arizona, prosecutors have 48 hours to press charges when a suspect is in custody. “If charges aren’t filed within that time frame, the suspects must be released,” Kolsrud said. “However, prosecutors and law enforcement still have up to seven years to decide if they have enough evidence to bring charges.” The case’s location at an airport adds another layer of complexity, as federal charges and investigations could come into play. “The FBI will likely want to know why someone brought a firearm or a knife to the airport and whether there was any intent to breach security,” Kolsrud added. A Separate Incident: Suicide by Cop Two hours after the initial altercation, a separate and equally troubling event occurred. A man, reportedly mentally distressed, arrived at the airport armed with three firearms. “This individual mistakenly believed there was an active shooter at the airport and showed up with two handguns and a rifle,” Kolsrud explained. “But it wasn’t to help anyone—he wanted to commit suicide by cop.” The man handed two of his weapons to a security… #InTheNews #gunlaws

"What's the mission?" That is a question that must always be at the forefront of any emergency response team member during any assignment. It's important to note that the "mission" is subject to change at a moment's notice and often multiple times during any one event. On June 12, 2024 the Ogle County, IL Emergency Response Team responded to a home in Dixon, IL in response to a 911 call from a woman who reported that her adult son had suicidal/homicidal ideations while he was alone in the residence armed with multiple firearms. It is reported that his Illinois Firearm Owner's Identification card was revoked due to being deemed a "clear and present danger." After multiple failed attempts to contact the individual on his cell phone and via a throw phone (50+ attempts), the team was authorized to enter the home by force. Members were met with gunfire and returned fire. The video below starts at the moment the team approached the door to the residence. Three members of the team were shot as was the individual. The wounds were non-fatal but one officer required surgery. I've received multiple phone calls and emails today regarding the events captured in the video. Suffice it to say that the law enforcement community is not in agreement with how the event was handled. IMHO, it's too soon to comment with any type of authority. The Illinois State Police has been tasked with conducting the investigation into the incident. *EDIT* points for discussion/training: 1) Assuming there is no warrant, is there a duty to make entry? 2) Based on the sole facts described above, what are the legal bases for making entry? Does/will your answer hold up in a civil Section 1983 action? 2) Let's add the fact that the individual's FOID card was revoked because he was deemed a "clear and present danger" and he failed to comply with IL state law re: revocation (see below comments for brief overview) which is a class A misdemeanor in IL. Please watch this if you are at all concerned with whether our government is willing and able to break their own rules and violate the rights of citizens. This is the ATF run wild. Watch as the director of the ATF refuses to answer three simple questions from the House Judiciary Committee chair. Watch as he refuses to answer: 1) why did you cancel a search warrant execution a week prior just because the subject wasn’t home? 2) why did the ATF bring a piece of tape and cover up the doorbell camera? 3) why did the ATF not wear body cameras despite the requirement to do so (and why did the Little Rock cops also not wear cameras despite a policy requiring)? 4) why did they cut the electricity to the home? 5) why did they serve a no knock search warrant (without arrest warrant) at 6a in the morning on a man with no apparent criminal history sleeping with his wife upstairs in full SWAT tactical gear and overwhelming force (in the audio that was available by nearby sources there was no declaration they were law enforcement that I heard)? OPINION: This was a state-sanctioned hit by a severely anti-gun Biden Administration to “send a message.” Not that they necessarily went in with the premeditated intent to kill, but they went in “hard” on purpose to terrorize and scare a gun collector citizen that may have run afoul of the Biden Administration’s litany of new gun regulations that practically require a law degree to understand. This hit was to scare us all. This is government overreach, aggression, and corruption. Watch the ATF director. Watch him dodge Congress intentionally in simple questions. The ATF has lost all moral authority in my view relevant to the average gun owning citizens. It is an agency dedicated now (under Biden) to wage war on the Second Amendment since SCOTUS is reemphasizing the strength of the Amendment that protects all the others (understanding that there is a substantial portion of ATF that still goes after actual bad actors). This is why I practice both firearms law and criminal defense. This is why I fight. The boys over at Scott Prop and Roll worked with armourers John Navarro and Dutch Merrick to create the best explanation of firearms handling on set. I think it should be a must watch, and added to all studio, Unions, and Guilds training orientation sessions for all crew.

It's frustrating to see headlines like "Cops shoot man accused of jumping subway gate," completely ignoring the actual facts. The man was threatening passengers with a knife (you have to watch 2 minutes into the video for that to be mentioned), and the officers were trying to protect the public. While it's important to point out that innocent bystanders, and other officers, were injured in the crossfire—a clear training gap that needs to be addressed—the reality is that in high-pressure situations like this, officers can develop tunnel vision, hyper-focused on the immediate threat. This isn't an excuse, but it is a reality. Better training for police is absolutely necessary, but misleading articles only gaslight the public and distort the truth.
