In a win for The Everglades Foundation, a Florida appellate panel agreed with a court decision that Dr. Thomas Van Lent intentionally violated a court injunction barring him from deleting critical research and more than 760,000 files he allegedly stole upon resigning from his position as scientist and IT administrator. As KTT Managing Partner Jorge Piedra tells Law360: "As stated and confirmed by both the trial court and the Third District Court of Appeal, and even as admitted by Dr. Van Lent in my cross-examination, he intentionally violated a court injunction. The court followed the Rules of Criminal Procedure – to a t – and afforded Dr. Van Lent every necessary and available due process right at all stages of the proceedings." He added that this case “was an employment dispute where the trial court found that Dr. Van Lent deleted and destroyed his former employer’s data” and that “the appeal was about the rule of law and a Court’s authority to enforce its own order that was intentionally violated by Dr. Van Lent.” Jorge, who represents the Foundation, was appointed by the court to prosecute Dr. Van Lent.
