A Super Bowl commercial advertising weight loss drug Hims & Hers has sparked a debate in the health care sector, bringing to the surface the question, 'How does the FDA regulate advertising for copycat products?' Member Joanne Hawana was quoted in a Bloomberg Law article about the commercial. She points out that the distinction between a “drug ad” and a “telehealth ad” has an impact on whether the FDA or FTC has primary policing authority over the content. She says, "Under current law, a pure telehealth ad that is trying to induce consumers to buy those services, rather than to buy a certain drug, would absolutely fall within the scope of Section 5 of the FTC Act and FTC’s enforcement authority over deceptive acts and practices in commerce." https://bit.ly/3CFHhGy

Massachusetts employers now face new salary reporting rules and must prepare for upcoming pay transparency obligations. Member Natalie Groot was featured in a Boston Business Journal article about the Massachusetts pay transparency law and its potential effects. Natalie comments, "The employee impact is crucial. Existing employees, maybe for the first time, are going to see pay scales for jobs they've held. Now, all of a sudden, they might ask questions (like), 'I was in that job for years, and my pay wasn't in that range. Why aren't I being paid back?
