Interim remedies play a crucial role in resolving disputes, but enforcing interim measures can be complicated in the United Arab Emirates. The UAE's multi-territorial, multi-jurisdictional legal system includes both onshore civil law courts and offshore common law courts – the Dubai International Finance Centre (DIFC) and the Abu Dhabi Global Market (ADGM) – each with its own rules and regulations. Depending on the jurisdiction or the forum where proceedings are being heard within the UAE, the availability of interim remedies and the procedures for enforcing them can vary significantly. As a result, the process can be complex, particularly if the judgment debtor's assets are located outside the jurisdiction where the interim order was granted. Contributors Robert Whitehead, Fahad Khalid, Jude Rishane Senanayake, and Rayan Bagundang of Hamdan Al Shamsi Lawyers & Legal Consultants provide an overview of the interim remedies available to litigating parties in both the offshore common law courts and the onshore UAE courts. They also outline the procedures for enforcing these remedies outside the jurisdiction where they were granted within the UAE. Practical Law Global subscribers can access "Enforcement of Interim Remedies in the UAE" here: https://lnkd.in/gN5nNREy. Helping clients comply with tax responsibilities imposed by governments around the world is a complex challenge, but Practical Law Global subscribers can gain clarity by tapping into a network of distinguished local experts. In "Tax Residency of Companies in the UAE," contributors Alastair Glover and Lily Hurley of Stephenson Harwood LLP clearly lay out when resident and non-resident companies must pay UAE corporate tax. They also consider the effect of double tax agreements (DTAs) (also known as double tax treaties) on dual resident companies. For counsel who have only moments to get up to speed before an urgent client consultation, a flowchart offers a straightforward decision tree, summarizing the residence rules under UAE law. When governments use AI to exercise their powers, support their decision-making, or deliver services, questions of explainability and individuals' rights quickly arise. In "Transparent AI Use in the Public Sector (UK)," Alex Lawrence-Archer of AWO Agency explores the extent to which UK law requires a public body to offer insight into its use of AI, as well as how government guidance elaborates on those requirements. He also discusses when the public body must provide the information proactively and responsively, what information is likely to be required, the standard that information should meet, the processes for disclosing it, and potential consequences of non-compliance.
