About us
I’ve spent 20+ years specializing in the law affecting companies and programs in the outdoor recreation industry. My clients range from universities to Everest guides to equipment manufactures. I’ve defended raft companies, mountaineering guide services, canoe liveries, climbing, ropes courses and others in court. I’ve published in the Wilderness Medical Society Journal, Paddle Dealer, Inside/Outside, Scouter, GearTrends & Recreation Management. I was a contributor to the Risk Management Chapter of the BSA Field Book and have written chapters in Legal Liability and Risk Management in Adventure Tourism and Controversial Issues in Adventure Programming. I teach Ski Area Risk Management for Colorado Mountain College. I’ve taught seminars at Cornell, Oregon State University, University of Idaho, University of Utah and other colleges. I am the US representative to the Safety Committee of the Union Internationale des Association d’Alpinisme (UIAA) and a member American Society of Testing & Materials (ASTM). I currently serve on the board of directors of the Galapagos Conservation Association and the Denver Area Council, Boy Scouts of America. I have severed on the board of directors of the Trade Association of Paddlesports and the Colorado Alliance for Environmental Education. When I'm not practicing law or writing, I still work as a river guide for commercial whitewater rafting companies. I know this area of the law and enjoy working with my clients to protect them from the issues they may encounter.

Charging for search and rescue (SAR) services is a contentious topic in the outdoor recreation community. While it is understandable that Kauai County, HI is considering a bill to cover SAR costs, implementing a fee of $1000 per hour could have unintended consequences. Charging for SAR services may deter individuals from seeking help in emergency situations due to the financial burden. This could potentially lead to more risky situations and increased danger for those in need of assistance. Additionally, this has shown it places SAR personal at greater risk also. Instead of charging individuals for SAR, it may be more effective to focus on education and prevention programs that promote responsible outdoor behavior. This could help reduce the need for rescues and ensure a safer environment for all outdoor enthusiasts. https://lnkd.in/gYK9cudh @RecreationLaw #SAR #Search_Rescue #BoycottNH #NoChargeforRescue #NoChargeforSAR #RecLaw #RecreationLaw

In a recent development, a South Korean court has ruled that the South Korean Alpine Federation is responsible for the costs incurred during the rescue operation of a deceased member on an 8000' peak in Pakistan. This decision has created a stir in the mountaineering community, prompting discussions on the issue of financial responsibility in high-risk activities. The court's decision to charge the Gwangju Alpine Federation for the rescue costs raises important questions about risk management and accountability in mountaineering. The court's ruling suggests that organizations involved in such activities may be held financially liable for rescue operations, even in cases where the individual involved has tragically lost their life. It is crucial to note that mountaineering organizations and climbers alike should consider the potential financial implications of such incidents. This ruling serves as a reminder for climbers and mountaineering organizations to ensure they have appropriate risk management strategies in place, including comprehensive insurance coverage and contingency plans for emergency situations. Additionally, climbers should be aware of the potential legal and financial ramifications associated with their chosen activities. While this particular case pertains to South Korea, it raises broader concerns and implications for the global mountaineering community. Clarity on the responsibilities and liabilities in rescue operations is necessary to prevent further legal disputes and to safeguard the future of mountaineering. https://lnkd.in/g_fEuzaa @UIAAmountains #Mountaineering #MountaingClimbing @RecreationLaw #RecLaw #RecreationLaw #Mountaineering #MountaingClimbing #RiskManagement
