Exploited migrant workers who get mistreated on the daily while working on British farms are also facing huge barriers taking their employers to court – including rules that stop them from giving verbal evidenceI . The six-month seasonal worker visa, which was launched in 2019 and now brings 30,000+ workers to the UK each year, has been widely criticised for systematic bullying, abuse and underpayment. And yet inequalities in the legal system put migrant workers trying to fight this exploitation at a significant disadvantage. Their visa allows people to stay in the UK for up to six months but cases can take as long as two years to be heard – and those living abroad are usually barred from giving oral evidence. On top of facing language barriers and difficulty in accessing free legal advice, those who speak out while still being employed in some circumstances lose their jobs, resulting in a widespread climate of fear. 🗣️“Workers in the UK have rights, and there is nothing about [the visa scheme] that enables workers to enforce those rights” – Jamila Duncan-Bosu, an employment lawyer and co-founder of the Anti-Trafficking and Labour Exploitation Unit charity.
