  • As we get ready to start a new year, what’s one of the first things we will all do? Prepare a list of our resolutions, of course! Is this the year we start exercising? Start dieting? Start saving money? Or is this the year we finally remember to file for homestead on our primary property. There are many times where individuals purchase a property, but then forget to file for homestead. One of the biggest reasons to do so is to save money on your taxes. A homestead residence receives more favorable property tax incentives. Not to mention the legal protections afforded to Floridians under the homestead laws. As long as an individual owns the property and is living in said primary property as a permanent resident on January 1st, then that individual can apply for homestead within that year, provided that the individual remembers to actually file within a timely manner.   • There is a universal love / hate relationship with timeshares.  Nonetheless, when creating your estate plan, it is important to discuss them with your attorney and plan for them.  A timeshare is a vacation property that a person owns in limited time increments or perhaps via a point system. Some timeshares include an interest in land or a mere license. Interestingly, upon a person’s death, if the timeshare includes an interest in land, a probate administration may be required.  Timeshares can be for one property or several in the same or different locations. Asking a client whether they have a timeshare is important for the attorney to determine what the client owns. Once it is determined what the client owns, the attorney then must apply that timeshare’s rules to determine what to do with the timeshare.  Depending on what the client wants to do with their timeshare in their estate plan, the attorney may have to contact the timeshare company about the transfer process, adding new owners, and selling the timeshare.     Had such a wonderful time tonight with my Dad and some awesome colleagues and friends at the Broward Attorneys Real Estate Council - BAREC Holiday Party at Lauderdale Yacht Club-LYC. I was so honored to serve on the BAREC Board for the past seven years and I’m so proud of the Board we have in place for 2025. Donald Walters has served as President for the past 20 months and he did an incredible job. I am sad to leave the Board, but so glad to leave it in such good hands. I hope everyone has a Merry Christmas, Happy Hanukkah and a very Happy New Year!!! We were also really happy to raise money and gifts for the kids of Children's Harbor, Inc.   • Jacqueline and her husband always look forward to the Brandt Holiday Party and this year was the best one yet!

  • What an awesome holiday party by BCBA!

    The 2024 Annual Holiday Party of the Broward County Bar Association was a great way to kick off the holiday party circuit. Christopher and I very much enjoyed spending time together with friends and colleagues while enjoying the libations, Photo Booth, delicious food and an incredible atmosphere as it was held at the Museum of Discovery and Science in Fort Lauderdale.   • HORROR STORY TIME - When preparing estate planning documents, it’s crucial to have a qualified lawyer by your side. Attempting to create these important documents without proper legal expertise can result in costly mistakes or unintended consequences. Case in point. We recently met with a client who completed some “forms found online”. One of those forms was a deed. Without proper counseling and without truly understanding what he was doing, he inadvertently changed the title to his home. The change in ownership triggered a reassessment with the county’s property appraiser’s office - his property’s assessed value tripled, which means that his annual property taxes are going to triple. Additionally, he lost his homestead exemption on his property. A mistake is now going to cost this client quite a bit going forward. Remember, a lawyer is here to help you navigate through complex laws, to ensure that your plan is up-to-date and compliant.
