On March 22, 2024, the Cyberspace Administration of China (“CAC”) issued the long awaited Regulations on Promoting and Regulating the Cross-border Data Flow (“Regulations”). The full text of the Regulations can be found at https://lnkd.in/gCP7h8Rz. The Regulations greatly clarify and relax requirements that apply to the cross-border transfer of data out of China. A few key developments worth noting include: - Under the Regulations, data processors would be exempted under prescribed scenarios from filing a data export security assessment, entering a personal information export standard contract, or passing personal information protection certification. For example, > Where the data is not classified as “important data”, the data processor would be exempted from filing a data export security assessment. > Where (1) the data is generated from international trade, cross-border transportation, academic cooperation, transnational manufacturing, and marketing, and does not contain personal information or "important data"; or (2) the data consists of personal information collected and generated out of China which were transferred into China for processing, and where no personal information or “important data” were introduced in the process, the data processor would be exempted from all 3 requirements. - The Regulations also empower pilot free trade zones (FTZs) to determine their own “Negative Lists” of types of data, for submission to the state authorities for approval. Once approved, data processors within such FTZs would also be able to freely transfer data out so long as such data does not fall within the types of data provided in such Negative Lists. - The Regulations take precedence over the previous Regulations and measures concerning cross-border transfer of data. Maximilian Butek, Executive Director and Board Member of the German Chamber of Commerce in China (GCC) for East and Central China, confirmed the news of Scholz's upcoming visit to China at a press conference in Beijing on April 10, saying that the German chancellor is usually accompanied by a high-level business delegation on major foreign visits. The list of executives on this trip underscores the significance of China as Germany's largest trading partner. Maximilian Butek also told us that 10-15 executives from German companies are expected to accompany Olaf Scholz to China. “China is the most important trading partner for us," Maximilian Butek said, "Last year, in the case of China's actual use of foreign capital decline, German foreign direct investment (FDI) in China has soared against the trend, which shows the confidence of German enterprises in the development of China. For any German CEO, it is natural to attach importance to the Chinese market. Moreover, German companies have created more than 1.1 million jobs in China. For German companies, which rely heavily on human capital, it is also important to strengthen communication with these employees and consolidate their trust." This year marks the 10th anniversary of the establishment of comprehensive strategic partnership between China and Germany. Last year, despite the decline in Sino-German trade volume, German foreign direct investment in China hit a record high with its proportion of total German outward investment also reaching the highest level since 2014. Since 2016, China has been Germany's largest trading partner for eight consecutive years. In fact, many German executives who will accompany Scholz to China this time have just attended the annual meeting of the China Development Forum 2024 in Beijing. At the annual meeting, they expressed their high regard for the Chinese market and their expectations for China's further opening up. Roland Busch, President and CEO of Siemens AG, said that new productive forces represented by high technology, high efficiency and high quality is the future development direction and will bring development opportunities to all parts of the world, including China. He called for more openness and better cooperation, hoping to achieve higher-quality cooperation with Chinese companies and further develop new productive forces. Ola Kaellenius, the chairman of the board of management of Mercedes-Benz AG, and CEO of Mercedes-Benz, noted that in the past few years, China has sent positive signals to foreign companies and investors about opening up its automobile market, which has greatly enhanced the market confidence. He believes that with the concrete implementation of the opening-up policy announced by the Chinese government, the confidence of international investors will be greatly enhanced and will also bring tangible benefits to multinational companies. Pedro Antunes, a professor of political science, believes that it is difficult to guarantee that this can be done in Europe. João Pedro Pereira, president of the Portuguese Chamber of Commerce, believes that the EU's "fear" of China is "unfounded". 2024-10-18 Lu Shaoming Gonçalo Francisco, Gu Zelin Guilherme Rego Enviaste "VISA-FREE ENTRY MEANS THAT MORE AND MORE CHINESE CITIZENS WILL GO TO EUROPE, AND MORE AND MORE INVESTMENTS IN EUROPE WILL BE CEDED TO CHINA. That's what they think, so the European Union does not exempt visas. Portugal is a member of the European Union and will abide by the relevant rules. Professor of Political Science Pedro Antunes On the last day of September, China announced a trial visa-free entry for Portuguese citizens who came to China for no more than 15 days. On the same day, China also revealed that it hoped to exempt each other from visas, that is, Chinese citizens can also enjoy visa-free treatment when traveling to Portugal, while at present, only Macao and Hong Kong citizens enjoy this right. We are establishing a public-private partnership platform to eliminate transportation gaps and are now recruiting members! A new public-private partnership platform has been launched to eliminate "transportation gaps," with recruitment for members now open. This initiative aims to unite local governments, transportation operators, and various organizations to address transportation challenges nationwide. The recruitment period runs from November 25, 2024, to January 24, 2025. Eligible applicants include local governments, transportation operators, and organizations willing to contribute resources, technology, and networks. The initiative encourages participation from stakeholders considering the needs of inbound tourists, young people, women, and people with disabilities. Interested parties must submit an application form and relevant documents, including written consent from authorities, a business presentation, and a pledge to exclude organized crime. Applications should be sent to the specified email address. After the application period, the Ministry of Land, Infrastructure, Transport and Tourism will review submissions and notify successful applicants about their membership and future initiatives. The Ministry may deny membership based on appropriateness and can request member involvement in additional activities like surveys and interviews. I find that many foregin nationals don't know the notification. The immigration office has been very strict about the notification. Please understand this rule and do it even if you delay. If you break this rule, you may be given a visa for a shorter period at your next renewal. If the contracting organization changes its name or location, ceases to exist, terminates the contract with the contracting organization, or concludes a new contract, the Director-General of the Immigration Services Agency shall notify the Director-General of the Immigration Services Agency within 14 days according to the procedures specified by the Ministry of Justice Ordinance. must be notified. *On the Immigration website, there is a tab in the lower left corner to change languages. https://lnkd.in/gqk5fz5c #japan #visa #tokyo #notification

“Chinese companies usually depend heavily on sending many Chinese experts, but a shift is noticeable where many Chinese companies are now optng to hire locally. This decision stems from the desire to access essential technical expertise, support and produciton or service localization,” Jim McCoy, Atlas Global CEO said in an exclusive interview with the 21st Century Business Herald. “Chinese companies may not have a strong global presence yet, but their reputation is rapidly gaining recognition." In the midst of the globalization boom, an increasing amount of companies are extending their operations on a global scale.
