UP Police Need to Be Sensitised: Supreme Court on Criminal Cases Over Civil Issues The Supreme Court has expressed concern over the Uttar Pradesh Police registering criminal cases in matters that are essentially civil in nature, particularly against gangster Anurag Dubey. "You tell your DGP we can pass strong orders. Police are assuming the powers of civil courts; they need to be sensitised," remarked the Bench of Justices Surya Kant and Ujjal Bhuyan. The Court emphasized the need for fair investigations and extended interim protection to Dubey, stressing that he cannot be taken into custody without its permission. This calls for introspection on the role of police forces in handling civil disputes. Independence of Police! Issue related to independence of police has been discussed for quite a time now by the members of the civil society as well as by the Constitutional Courts. There have been innumerous incidents wherein police has been accused for having biased investigation, high handedness, improper use of power, etc against various sections of the society. We have witnessed blatant misuse of power by police from 1984 till around 1991 in Punjab wherein extra judicial killings, institution of false criminal proceedings and misuse of special powers for detention of accused. Recently, security of a sitting High Court Judge of Punjab and Haryana Court was compromised in the state of Punjab wherein service pistol was snatched from a PSO escorting the judge. The suo moto order passed by the Hon’ble High Court has mentioned that in the past various orders were passed by the judge against the functioning of Punjab Police. This incident has raised many doubts on the functioning of a state police and independent investigation would reveal that whether there was any link existed with the orders passed by the Judge or not. In this background, it is the need of the hour, to initiate police reforms on the lines of the recommendations of the Law Commission which have submitted its reports in the past #Police #Lawcommission #Judiciary #misuse #security

Extra judicial confession is a confession made before any person other than judicial authorities i.e. magistrates or judges, and is considered as a weak piece of evidence for the purpose of deciding the guilt of a person. The acceptability of such extra-judicial confessions usually depends on the credibility and trustworthiness of the witness to the confession. Confessions made before police authorities are also extra-judicial confessions, and cannot be solely relied on for determining guilt. This is because there is a high chance of coercion or threat to confess something before police officers, and such a confession made to police officers can only be good evidence if there are supplementing evidence to confirm the confession.
