It is hard to believe, but Aylo, owners of Pornhub and many other partner sites which post content onto that site, has told James Titcomb at The Telegraph that they are not actually a 'porn' site, but are in fact a social media site! Their claim is that the site hosts "user" generated content - but many of those users are subsidiaries of Aylo, and the general public cannot post content. Hard to believe, but we have seen the adult sector look for every opportunity to resist or delay #AgeVerification and #AgeEstimation requirements in the courts. Ofcom has not yet published its final guidance and, as part of their formal consultation on the draft version, we highlighted the need for absolute clarity as to which Part of the Act adult sites fall under. The draft guidance already states "We are likely to consider a service provider to have exercised control over the pornographic content appearing on its service where it exercises editorial control over the nature, selection or presentation of the content." Pornhub has helpfully now emphasised the need to tighten this guidance before publication As US judge, Justice Potter Stewart, said back in 1964 when trying to define porn: "I shall not today attempt further to define the kinds of material I understand to be embraced... but I know it when I see it ..." The porn industry and Big Tech, which also has an interest in this legislation, argue that free speech requires that American adults get their porn without delay, even if that means little kids can get it, too. But the porn industry is actually not about speech. It's about money. As Kristof put it, "[Pornhub] attracts 3.5 billion visits a month, more than Netflix, Yahoo or Amazon. Pornhub rakes in money from almost three billion ad impressions a day. One ranking lists Pornhub as the 10th-most-visited website in the world." Online porn companies are addicting American kids because addiction keeps children on their platforms, where they can be primed for manipulation by graphic advertisements from third parties. The solution to this crisis is age verification. It works. I awarded a 9 out of 10 on the whopper index for those claiming in their Amicus Briefs (AB) filed with the US Supreme Court opposing age assurance for #porn sites, that it’s easy for a child to spoof facial #ageestimation (FAE) by presenting a picture of an adult to pass the age check. Today I look at a ‘7’ whopper claim that it’s too expensive for adult sites to check age. There’s no denying there’ll be a cost for porn sites to check age but the costs mentioned by the Internet Law Professors in their AB are absurdly high. The authors (see below) state that one porn operator says authenticating 7 million readers per month can “cost upward of $7 million” an eye watering $1.40 per check. The authors add that several commercial verification services cost a minimum of $40,000 per 100,000 checks - $0.40 per check - & that if Pornhub had to check the age of its 115 million global daily users, at a cost of $0.12 per check, the bill would be $13.8m per day, just over $5 billion potentially for a lucky AV provider. In the UK, research carried out for Ofcom included feedback from just one porn operator who said an age check would cost £0.10 to £0.20 adding up to an unfeasible cost of £500,000 per month for the UK alone. Readers need to understand that market prices vary greatly depending upon: 1) what age check methods a business offers individuals and 2) whether the age check is for a new or existing account owner or for a free to view porn site that may need to age check an anonymous porn viewer (who does not have an account) several times a month or year. In some countries a mobile phone operator may charge $0.40 for an age check where the phone buyer with that mobile number may have been ID checked in a shop or online. Most porn sites won’t pay such high fees. There are already 10-15 or so FAE vendors competing for business & prices per check for porn operators range from $0.20 down to less than $0.01 depending upon volumes & whether the check is once only for an account owner or not. No-one gets younger in life so an end user only has to prove age once & could return to their porn account for years to come. Yoti does not charge any business globally a fee for receiving a Yoti app user anonymised Over 18 credential. Finally the most popular type of age check will be age tokens where a user gets age checked & then is issued on their browser a signed age token that other porn operators can check. This enables adult porn viewer to consent to view porn for hours, days, weeks at multiple websites without doing another age check. Age checks will be super popular with individuals & high traffic & lower traffic frees to view porn sites given the low friction & very low costs. If the most popular free to view porn sites use a mix of age tokens (where allowed by sensible regulators), the free Yoti app & FAE, their costs will be a fraction of the whopper costs quoted in the Internet Law Professors AB or fed back to Ofcom.

Slashdot reader fjo3 shares a report from Politico: Officially (and drily) called the Digital Wallet Beta (Cartera Digital Beta), the app Madrid unveiled on Monday would allow internet platforms to check whether a prospective smut-watcher is over 18. Porn-viewers will be asked to use the app to verify their age. Once verified, they'll receive 30 generated "porn credits" with a one-month validity granting them access to adult content. Enthusiasts will be able to request extra credits. While the tool has been criticized for its complexity, the government says the credit-based model is more privacy-friendly, ensuring that users' online activities are not easily traceable. The system will be available by the end of the summer. It will be voluntary, as online platforms can rely on other age-verification methods to screen out inappropriate viewers. It heralds an EU law going into force in October 2027, which will require websites to stop minors from accessing porn. Eventually, Madrid's porn passport is likely to be replaced by the EU's very own digital identity system (eIDAS2) -- a so-called wallet app allowing people to access a smorgasbord of public and private services across the whole bloc. Have your say on how the online industry will protect children from graphic pornography and other high-impact content 🔞 Australia's peak communications, digital and video game industry associations have released draft codes for community consultation. Earlier this year, eSafety issued notices to industry associations requesting that they draft mandatory measures to prevent children from encountering material they are not ready to see and are too young to understand. eSafety also asked that the codes establish measures which would empower all Australians with better options and tools to manage their exposure to certain online material. While they focus on pornography, the draft codes also relate to other high-impact material including themes of suicide, self-harm and disordered eating. The draft codes apply to app stores; apps and websites - including porn websites; search engines; social media services; hosting services; internet service providers; instant messaging, SMS, chat, multi-player gaming, online dating services; and equipment providers. The draft codes are available at www.onlinesafety.org.au and the industry associations are inviting feedback from consumer organisations, civil society groups, academics, industry, parents and community members. After the industry associations provide the codes for registration, the eSafety Commissioner will assess each code to ensure they provide appropriate community safeguards. If any do not, the Commissioner can move to determining standards instead. This is the second phase of codes being developed under Australia's Online Safety Act, following a first phase of industry codes and standards which require industry to take meaningful steps to tackle child sexual exploitation, terrorist and violent extremist material.
