Does it seem like you've been getting more Section 101 rejections recently? That's because the USPTO's rate of making 101 rejections in OAs is reaching an all time high this year and is on the cusp of overtaking the pre-2019 PEG (2019 Revised Patent Subject Matter Eligibility Guidance) level of rejections. The most dramatic increase in §101 rejections seems to be in USPTO’s working group 2120, which examines patent applications related to AI. Much more here:

In July 2024, the U.S. Patent and Trademark Office (USPTO) issued a guidance update on patent subject matter eligibility to address innovation in critical and emerging technologies, including artificial intelligence. 2024 Guidance Update on Patent Subject Matter Eligibility, Including on Artificial Intelligence The United States Patent and Trademark Office (USPTO) issued updated guidance on patent subject matter eligibility, especially for AI-related inventions, effective July 17, 2024. This update aligns with Executive Order 14110 on the "Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence" issued by President Biden. The guidance aims to help USPTO personnel and stakeholders evaluate the patent eligibility of AI inventions by providing new examples and addressing recent Federal Circuit decisions. It integrates feedback from stakeholders and outlines the steps for determining if claims related to AI technology are patentable under 35 U.S.C. 101. The guidance emphasizes a two-pronged approach: identifying if a claim recites an abstract idea or other judicial exceptions, and determining if the claim integrates these exceptions into a practical application. This update reflects the USPTO's ongoing efforts to bring clarity and consistency to the patent eligibility analysis, particularly in emerging and critical technologies like AI. USPTO Issues Inventorship Guidance for AI-assisted Inventions Published on: : 02/12/2024 Reading Time: 5 minutes 1. The US Patent and Trademark Office (USPTO) has released guidance for AI-assisted inventions to promote, protect, and encourage investment in innovations facilitated by artificial intelligence (AI). 2. The guidance, effective from February 13, aims to clarify the patentability of AI-assisted inventions, aligning with the Executive Order on the Safe, Secure, and Trustworthy Development and Use of AI. 3. Kathi Vidal, Under Secretary of Commerce for Intellectual Property and Director of the USPTO, emphasizes the patent system's role in fostering human ingenuity and investment, striking a balance between patent protection and promoting collaborative innovation. 4. Contrary to being categorically unpatentable, the guidance highlights that AI-assisted inventions can be eligible for patent protection, emphasizing the importance of human contribution in the innovation process. 5. The guidance instructs examiners and stakeholders on evaluating the significance of human involvement in AI-assisted inventions for patent qualification. It builds upon the existing inventorship framework, providing guidance on naming inventors for inventions created collaboratively with AI systems. 6. To aid understanding, the USPTO offers examples of hypothetical situations on their AI-related resources webpage, illustrating how the guidance applies to various scenarios. 7. The USPTO encourages participation in a public webinar scheduled for March 5, from 1-2 p.m. ET, providing an opportunity to learn more about the guidance, ask questions, and offer feedback. 8. Additional insights on the guidance can be found in the Director’s Blog on AI and inventorship guidance, emphasizing the goal of incentivizing human ingenuity and investment in AI-assisted inventions. 9. As Big Tech acquires more resources that enable them to copy and recreate the innovations of others, including AI-related technologies, the need for patent protection has never been greater. Small companies need every protection they can get in today’s business landscape to defend themselves from predatory Big Tech companies, and patents are vital tools for smaller companies that can offer needed protection to ensure long-term success. In a recent article, Blueshift IP co-founder Robert Plotkin uses the example of biotech firm Masimo’s victory against Apple when the latter infringed the former’s blood oxygen monitoring technology.
