In a spate of white-collar criminal litigation, specifically involving s. 489-F of the Pakistan Penal Code, which is a non-bailable offence in our criminal justice system, three ingredients have a complex inter-play: (I) a liability or an obligation that needs to be discharged ; (II) the cheque is dishonored on presentation ; (III) and the cheque was issued dishonestly. A simple bounce cheque will not do. We successfully argued today, in a bail hearing, that although the million rupee cheque was dishonored, the first element, i.e., the obligation or liability of one million rupees cannot be prima facie established at this early stage. Available record in the indictment stage was a cash deposit of PKR 400,000 by a person S. in the accused's account. However, the person who launched a First Investigation Report (FIR) is Y -- the complainant in this case. Moreover, the FIR and the record is silent as to the relationship of Y with S. As explained quite brilliantly in the Order attached below, consonant with our oral arguments, by the XI Judicial Magistrate of District East, Karachi, the case at this stage requires 'further inquiry' because the liability before the issuance of the cheque is not prima facie established under the precepts of S. 497(2) of the Pakistan Criminal Procedure Code --- the provision which deals with the law of bails in Pakistan -- Result: accused granted bail. 1. The implementation of Tort Law and Tortious liability seems to have escaped our Judicial and Legal system 2. The concept of damages in liue of negligent breach of duty on behalf of Public Functionaries as well as common citizens must be introduced as a remedy and implemented to the fullest extent 3. Various organs of the State and State institutions rein freely negligent in Pakistan because there’s no check and balance on these institutions, Tortious liability and damages in lieu of the same can curb negligence enmasse on behalf of our Public Functionaries and common citizens 4. Our Legal and Judicial system must develop entrenched jurisprudence on the law of Tort 5. The landmark case of Donoghue v Stevenson, 1932 (UK) is a prime example of Tort law in action 6. We may refer to Justice Athar Minallah’s additional note in the “90 days Elections” matter as a “small step” for a Judge but a “giant leap” for the Judiciary as a whole

The question before court is requiring determination is whether a witness not fully conversant with the facts and circumstances of the case would be a competent witness within the meaning of Rules 1 and 2 of Order, III C.P.C.
