The Information Commissioner's Office (ICO) has just released new guidance on data protection fines. This comprehensive document outlines their approach to levying fines for breaches of data protection laws. With the new guidance, the ICO will: ✅ Assess infringement severity ✅ Consider turnover if part of an undertaking ✅ Set a starting point based on severity and turnover ✅ Adjust for aggravating/mitigating factors ✅ Ensure the fine is effective, proportionate, and dissuasive 👇 Our Senior Data Protection and Privacy Solicitor, Becky White says, “In light of the ICO's updated guidance, organisations should review their approach to data protection compliance and ensure it is fit for purpose. They should also be aware that the ICO publishes details of enforcement action, which can impact a business's reputation and lead to devastating financial consequences that many may find impossible to recover from.” Business owners should also ensure their teams comply with GDPR, as non-compliance can result in fines of up to £17.5 million or 4% of total annual worldwide turnover. Delete it? Destroy it? Anonymise it? Data protection law tells us we must not keep personal data for longer than necessary for the purposes it was collected for. Sounds easy doesn't it? But in practice one of the more challenging principles to uphold. First we need a policy, and most importantly retention schedules which set out how long different datasets should, or must be kept for. Then we actually need to have a robust plan and the technical capability to get rid of data or anonymise it. At the Westminster Insights data protection conference this morning. Owen Rowland from DSIT was speaking on the Data Protection and Digital Information Bill. Still no confirmation on timing - he “hopes” the Bill will receive Royal Assent before the summer recess but no guarantees. Also no further clarity on what will constitute high risk processing, which is apparently still being discussed, in particular whether this should be defined in the legislation or guidance. Lots of questions from the audience about how the senior responsible individual role will work. The message was clear that most responsibilities can be delegated (probably to a DPO) but that the individual will retain personal responsibility for compliance. For organisations that are subject to both U.K. and EU GDPR, apparently the only real difference will be the need for an SRI and a complaints procedure. Sounds so simple… So, no real answers on the major outstanding issues and no certainty on whether there will be parliamentary time to pass the Bill before the next election. #DPDIBill #dataprotectionreform #HelloDPO
