A graduate in Environmental Science from the Faculty of Geography of the University of Bucharest and with 10 years of experience in the field, Mihai coordinates the activities of managing contaminated or potentially contaminated sites, establishing and implementing remediation objectives based on specific investigations and technologies. Mihai also has a very good expertise in conducting environmental regulatory and corporate compliance audits, environmental due diligence audits and in preparing technical documentations in the field of water management. He has also been involved in the implementation of green building certification projects, having the LEED Green Associate certification. PROCEDURES FOR CARRYING OUT ENVIRONMENTAL IMPACT ASSESSMENT Environmental Impact Assessment (EIA) IN TANZANIA - Section 81 of the Environmental Management Act Cap 191 requires all Developers of projects identified in the 3rd Schedule of the Act and detailed in the 1st Schedule of the EIA and Audit Regulations of 2005, to undertake Environmental Impact Assessment (EIA). -Section 82 of EMA Cap 181 requires that the EIA be carried out prior to the commencement or financing of the project. -Procedures for carrying out the EIA, identified under the EIA and Audit Regulations of 2005 identify nine key steps to be followed in the EIA process in Tanzania. These are: Step 1: REGISTRATION -Register the proposed project with NEMC, by submitting an application for the EIA certificate, where you will be required to fill in a ‘Preliminary Environmental Assessment Registration Form’ for your project(Via PMS). The application fee is (___/=TZs). -Please use Environmental Experts when filling in registration form and during preparation of the project as required by Regulation 6(3). Step 2: SCREENING -Return to NEMC (Via PMS) a duly filled Application Form attached with the Project Brief for screening by NEMC. The contents of the Project Brief must comply with the EIA and Audit Regulations of 2005. - Screening report is approved by the Council within 45 days from the date of submission of the brief as per Regulation 10(1). This application must be accompanied by the necessary information detailing the environmental impacts of the action, and it should propose measures to mitigate these impacts. 3. Penalties: Fines, and the entities may have to undertake corrective actions to address the environmental harm caused. 4. Environmental Impact Assessment: The application process may require an Environmental Impact Assessment (EIA) to evaluate the potential consequences of the activity on the environment and provide recommendations for mitigation. Role of Environmental Assessment Practitioners: Environmental Assessment Practitioners play a crucial role in the Section 24G process. Their involvement can include: 1. Assessment and Reporting: EAPs evaluate the potential environmental impacts of the unauthorised activity and compile the necessary documentation needed for the rectification application. They ensure that all relevant aspects of the environment are considered and assessed appropriately. 2. Public Participation: EAPs facilitate public participation processes, allowing stakeholders and affected communities to voice their concerns and provide input on the rectification plan. This ensures that the process is transparent and considers the views of those impacted by the actions. 3. Mitigation Measures: EAPs recommend mitigation measures that should be implemented to minimise the environmental harm caused by the unlawful activity. This can involve restoration efforts, changes to operational practices, or other actions aimed at reducing negative impacts. 4. Compliance Monitoring: Once the rectification plan is submitted and approved, EAPs may also assist in monitoring compliance with the conditions set by the authorities and ensure that the suggested mitigation measures are effectively implemented. 5.Advisory Role: EAPs advise clients on how to proceed with future projects to ensure compliance with NEMA and other relevant environmental legislation, helping to prevent similar unauthorised activities from occurring. The Environmental Compliance Certificate or ECC is a clearance document that binds the proponent or applicant to fulfill specific conditions to address the impacts of their proposed project on the environment. Presidential Decree 1586 issued in 1978 establishes this as a requirement for projects, which cover infrastructure, real estate, manufacturing, energy, and many others. Section 2 of this law establishes the Environmental Impact Assessment System (EIA) of the country, serving as the main requirement or document to be submitted to the government to apply for the ECC. What makes ECC unique is that, unlike other permits for which an application form is submitted, it is based on the EIA which is a technically prepared assessment. https://lnkd.in/gXibRu2W

Newsflash 🌍 Notice Title: National Environmental Management Act 107 of 1998 (“NEMA”): Human Settlements Environmental Implementation Plan 2020-2025 Government Notice: GN 4353 in GG 50105 on 9 February 2024 Commencing date: 9 February 2024 The Acting Director-General for the National Department of Human Settlements, in terms of section 11(1) and Schedule 1 of the NEMA approved the promulgation of the Fourth Edition Environmental Implementation Plan for Human Settlements 2020 – 2025. The Department of Human Settlements is required in terms of section 11(1) of the NEMA to develop an Environmental Implementation Plan (“EIP”). The Section requires that every national department listed in Schedule 1, and exercises functions that may affect the environment, must prepare an EIP that will be revised every five years. The purpose and objectives of the EIP are to coordinate and harmonize the policies, plans, programmes, and decisions of the various national departments that exercise functions that may affect the environment. Amongst the priorities set out in the ISO Environmental Management technical committee’s Strategic Business Plan 2023-2030 are strengthening ISO members through capacity building and advancing inclusivity and diversity in the development of ISO environmental management standards. One of the action items in the Strategic Business Plan is the creation of a Developing Country Engagement Strategy. The engagement of ALL countries in the work and activities of the ISO Environmental Management technical committee is critical. The challenges that face our planet, including climate change, water scarcity, biodiversity, and natural resource management, affect all countries and the best minds from around the world must be involved in the development of solutions. It is for this reason that we are launching a series of developing country focus groups to better understand the needs of National Standards Bodies and technical professionals from developing countries and to learn how the ISO Environmental Management technical committee can better support the engagement of developing countries in the activities of the technical committee.
