🗞 Just in: Commission signed the Council of Europe Framework Convention of AI and human rights, democracy and the rule of law. This groundbreaking initiative is the first-ever legally binding international treaty in the field of AI, and aims to ensure that AI systems are developed and deployed in ways that fully respect human rights, democracy, and the rule of law, while promoting technological innovation. The Framework Convention was developed with broad global collaboration, including input from member states, as well as observer and non-member countries, representatives from civil society, academia, and industry, ensuring a balanced and comprehensive perspective on how AI can benefit society while mitigating risks. Being fully compatible with the recent EU AI Act, this Convention requires governments and private actors to uphold fundamental principles such as transparency, accountability, and respect for privacy. By addressing both the risks and opportunities of AI, this treaty provides a robust framework for responsible AI innovation that aligns with global human rights standards. 🔜 This signature expresses the EU’s intention to become a Party to the Convention. Following this, the European Commission will prepare a proposal for a Council decision to conclude the Convention, and the European Parliament should also give its consent.

Today, the European Commission signed the Council of Europe Framework Convention on Artificial Intelligence on behalf of the European Union. The Convention is the first legally binding international instrument on artificial intelligence, fully compatible with the EU AI Act, which is the first comprehensive AI regulation globally. This Convention provides for a common approach to ensure that activities within the lifecycle of AI systems are compatible with human rights, democracy and the rule of law, while enabling innovation and trust. It includes a number of key concepts from the AI Act such as a risk-based approach, transparency along the value chain of AI systems and AI-generated content, detailed documentation obligations for AI systems identified as high-risk, and risk management obligations with the possibility to introduce bans for AI systems considered a clear threat to fundamental rights. The Convention will be implemented in the EU by means of the AI Act, which provides harmonised rules for the placing on the market, deployment, and use of AI systems, along with other relevant EU legislations where needed. With key signatories including the EU, the UK, and the USA, this Convention aims to ensure that AI systems respect human rights and democratic values throughout their lifecycle. Key highlights: - Scope: The Convention covers activities by both public authorities and private actors but leaves room for states to determine whether to extend its application to address private sector risks in their country. - Exemptions: Notably, it exempts activities related to national security and national defence, raising concerns about potential misuse to sidestep human rights obligations. - Implementation: States are encouraged to ensure a guarantee of human rights protection in both public and private sectors. As the International Commission of Jurists we were among the observers of the process of the Convention drafting. As we navigate the complexities of AI regulation, it’s crucial for signatories to commit fully to the Convention’s principles, ensuring a balance between innovation and the protection of human rights. 📢 Council of Europe to Consider AI Treaty - CAIDP, NGOs Urge Amendments ❗ The Parliamentary Assembly of the Council of Europe will meet on 18 April to consider action on the first global treaty for AI. NGOs, including the Center for AI and Digital Policy, the European Center for Not-for-Profit Law Stichting, AlgorithmWatch CH, and others, have worked tirelessly to ensure the AI Treaty upholds the Council of Europe's mandate to protect democratic values, fundamental rights, and the rule of law.
