Under Article 725 of the New Civil Code, DONATION is an act of liberality whereby a person disposes gratuitously of a thing or right in favor of another, who accepts it. A person who has the capacity to contract and capacity to dispose of his property may make a donation. His capacity shall be determined as of the time of making a donation. All those who are not specially disqualified by law therefore may accept donations. In line with this, the following donations shall be void: 1. Those made between persons who were guilty of adultery and concubinage at the time of donation; 2. Those made between persons found guilty of of the same criminal offense, in consideration thereof; 3. This morning, Michelle Abbott LL.B TEP and I had the pleasure of speaking at The Myriad Centre, a charity supported by Worcester HCR Law. Our session on Powers of Attorney, Deputyships, and Mental Capacity was well-received, with a packed audience (we even ran out of chairs!) We were able to address many parents' concerns about their adult children's future and the importance of Wills and Vulnerable Beneficiary Trusts. 16 years ago my state senator told me I would never get Erin’s Law passed in Illinois so he wouldn’t introduce the bill. You can’t tell this mama no and in 2013 Illinois passed it. I set out on a mission in 2008 to get this passed in every state. Today 38 states have Erin’s Law. Kerala, India started requiring it in 2022 and last month Ontario, Canada passed it. These lawmakers eventually discover I don’t go away. Some states have even taken me a decade. I don’t quit. In a few weeks I turn 40. My goal in 2025 is to pass Erin’s Law in 40 states. As ECLC celebrates its 50th year in operation, the team have been reflecting on how the collective passion, community support and commitment to helping communities experiencing disadvantage and discrimination led to establishing the then Nunawading Legal Service. Although community and law has come a long way since then – there is still so much work to be done. ECLC’s ongoing work in family violence and elder abuse advocates for integrated services and draws attention to systemic gaps that must be addressed before the abuse can be resolved. Throughout the years however, ECLC has faced major challenges in seeking sufficient funding to support the Centre’s work with local communities – 50 years on, similar challenges remain. While there is no danger of the doors closing at ECLC, there is a deepening crisis in legal help and ECLC is unable to meet demand from community members in need and regularly have no choice but to refer people away who desperately need the Centre’s support. The scale of funding we receive is not enough for the increasing number of people in need. On average our contact centre makes 900 external referrals in one year. 👉 The community deserves better and you can help us make a real difference by donating to our $50 for 50 campaign.
