A recent study by two law professors, Brian Frye (University of Kentucky) and C.J. Ryan (Indiana University) found that the U.S. News and World Report’s Law School rankings have become increasingly irrelevant for prospective law students. So, Frye has offered up an alternative. As I have been trying a case this week, I am reminded that the most challenging and consequential legal issue(s) almost always happen during the instruction conference.
Do not underestimate the importance of the jury instructions.
If you are like me, jury instructions were a mere passing shadow in law school. Seldom, if ever discussed, jury instructions are the law the jury gets from the judge.
You need to spend time on the instructions. You need to explain them to the jury so that they understand why your theory of the case matches up with the evidence.
Instructions - the class you never knew you needed. And the class almost no law professor is qualified to teach.

As always, great trial advocacy advice from Miller Leonard. These points are so important. Lawyers also must remember to make their objections to the final instructions the court will give. It isn't enough to submit your proposed instructions; you also must identify instructions you think are problematic and *why*. You don't preserve the record just by saying you generally dislike the final instructions. Look at Federal Rule of Civil Procedure 51(c) or your state analogue to understand how you make those objections. And don't forget that those final instructions might not be the same as what your opponent provided.
Pattern/model instructions are great tools. If your jurisdiction doesn't have them for the issues in your case, then see if other jurisdictions do. The ABA often publishes model instructions, so it is another source. [I remember using ABA instructions about surety in a trial before me. They were very helpful.] Don't be bashful about modifying model instructions to make them clearer, too.
Last, as others noted, use the instructions in closing. Show the jury what factors the law directs them to consider and suggest either how you met them or how your opponent didn't. Remember, this process is foreign to them.
