#Legalprofessionalprivilege requires adequate protection. ⚖️ One of the fundamental differences between the rule of law and authoritarianism lies in fair and rules-based justice, which cannot be exercised without independent legal assistance based on trust between the client and their attorney. 🔹 To create and protect this trust relationship, one of the cornerstones of the legal profession is the legal professional privilege – an obligation to maintain professional confidentiality, which must be respected by the state. 🔹 The European Court of Human Rights has found that Estonia lacks sufficient measures to protect legal professional privilege in the course of search of attorney’s premises and seizure of attorney’s electronic devices. 🔹 In a recent judgment, Tallinn District Court once again emphasized that legal professional privilege is inadequately protected in Estonia. 💡 Such violations could be easily prevented if legal professional confidentiality were taken seriously and clear rules were enshrined in law. 👉 Read more in https://lnkd.in/dYwUnPm9

Yesterday the Permanent Bureau of the HCCH had the honour of welcoming a delegation from Japan. The delegation was headed by Mr Ryuji Kawahara, Vice-Minister of Justice. He was accompanied by Ms Saori Kameyama, Assistant to the Director, Secretarial Division, Minister’s Secretariat; Ms Mayumi Komoto, Attorney, International Affairs Division, Minister’s Secretariat; Mr Katsutoshi Takahashi, Section Chief, Liaison & Coordination, International Affairs Division, Minister’s Secretariat; Ms Maki Masaki, Interpreter; and Ms Mio Takanashi, First Secretary, Embassy of Japan. The delegation met with Dr Christophe Bernasconi, Secretary General of the HCCH, accompanied by Ms Melissa Ford, Secretary and Head of the Transnational Litigation and Apostille Division, and Dr Louwrens Kiestra, Legal Attaché to the Secretary General. The meeting provided an opportunity to discuss recent developments and to strengthen the long-standing ties between Japan and the HCCH. The delegation expressed Japan’s support for the ongoing work of the HCCH, including its preparations for the upcoming meetings of the Special Commission on the 1965 Service, 1970 Evidence, and 1980 Access to Justice Conventions, to be held in July 2024, and of the Working Group on Jurisdiction, to be hosted by Japan in October 2024.
