The infrastructure sector has grown dramatically in the last several years, considerably increasing the GDP and performing a critical role in the advancement of the country. However, despite significant investment, infrastructure remains inadequate, with public sector focus shifting away and regulatory uncertainties persisting. *#ESG's Growing Significance in In-house #Legal Teams* Thomson Reuters have issued their brilliant 2024 report into the state of the UK Legal Market (A link to the full report can be found in the comments section). What I find most interesting is the response to the following question asked both in 2022 and 2023: "What would you say are the current strategic priorities for your organization’s legal function / legal department?" 13% in Mainland Europe and 11% in the UK listed ESG as a strategic priority in 2023 compared to just 5% and 2% respectively in 2022. With these figures more than doubling in just one year, it is a clear sign that ESG matters are increasingly at the forefront of legal decisions. Bodies Corporate play a critical role in the management and governance of sectional title properties in South Africa. Understanding their role, responsibilities, and the legal framework that governs their operations is essential for property owners and potential buyers. The Body Corporate exists to manage and administer the land and buildings in the scheme. This means, that the Body Corporate is required to enforce the legislation and rules in the Sectional Titles Act, the Management Rules, and the Conduct Rules of the scheme. Amongst their other duties, the Trustees manage the Body Corporate’s funds, enforce the rules and resolve conflict to the best of their ability.
