In summary: "To protect against other provisions in the law, hiring parties should also consider including the following items in their written contracts: - Specify the assignment of IP Rights. - Specify a due date for payment or a process for determining when payment is due - Carefully define the work to be performed" Point 3 in particular is a best practice everywhere.

New York’s new Freelance Isn’t Free Act (FIFA) is now law, and if you work with independent contractors, it’s time to pay attention. Effective August 28, 2024, this law mandates written contracts for freelancers performing services worth $800 or more. These contracts must include specific details about the work, payment terms, and more—failure to comply could cost you. Here’s what employers need to know: Written Contracts: Every agreement with freelancers should be documented, covering all required elements like service details and payment terms. Timely Payment: Freelancers must be paid by the contract’s due date, or within 30 days if not specified. Retaliation: Be aware that the law prohibits any form of discrimination or retaliation against freelancers who assert their rights. Penalties for non-compliance are steep, including fines and the risk of double damages. The Attorney General has enforcement power, and freelancers can also bring private lawsuits. If your business relies on freelance talent, now is the time to review and update your processes. Don’t wait until August to get your contracts and payment systems in order.
