Pan African Lawyers Union Annual Conference 2024! I will be attending this year's Pan African Lawyers Union (Official) Annual Conference in Addis Ababa, Ethiopia, where I shall be participating in the panel discussion session addressing an interesting topic --> Navigating Cross-Border Commercial Disputes in Africa: Leveraging ADR for Effective and Efficient Solutions. As intra-African trade continues to grow, driven by initiatives like the African Continental Free Trade Area (AfCFTA), businesses face increasing challenges in managing cross-border commercial disputes. The session will explore the role of Alternative Dispute Resolution (ADR), including arbitration and mediation, as an effective tool for resolving cross-border commercial conflicts across Africa. 🌍 Opening Ceremony & Keynote Speeches at the 11th East Africa International Arbitration Conference 🎤 We were honored to kick off the first opening ceremony of the 11th session of the conference with distinguished speakers like H.E. Dr Ermias Yemanebirhan from the Ministry of Justice and Hon. Thabo Chakaka-Nyirenda, the Attorney General of Malawi. Key insights from the session included: 🔹 Commercial arbitration strengthens the rule of law: It offers faster, more efficient resolutions in comparison to traditional judicial processes, which are often overcrowded and inefficient. 🔹 African solutions for African problems: Thabo Chakaka-Nyirenda highlighted Malawi’s admiration for the success of East Africa’s arbitration centers and emphasized the need for Africa to find its own solutions to disputes. 🔹 Modern arbitration frameworks: The transformation and adoption of modern arbitration laws are crucial for advancing fair and effective dispute resolution. 🔹 Malawi’s commitment to arbitration: Malawi has established its own International Arbitration Center, positioning itself as a key player in the region’s arbitration landscape. 🔹 Making Africa arbitration-friendly: Commercial arbitration achieves justice faster, offering an alternative dispute resolution that serves as a pillar of economic growth and fairness. During his opening remarks, Samuel Mbiriri Nderitu, FCIArb, FMIArb cc:Patrick Obath acknowledged that the theme for the 8th ICC Africa Conference, "Emerging Trends in ADR in Africa," is timely and essential, given the increasing need for effective ADR mechanisms. Kenya's rapid growth in sectors like construction has led to inevitable conflicts, highlighting the importance of ADR. The private sector, which accounts for over 28% of ADR disputes, benefits significantly from these mechanisms. Although ADR is still developing in Kenya and Africa, it has become the preferred method for resolving conflicts in a less adversarial manner, a key topic for the conference.
