The highly publicised criticism of ‘influencer’, Lauryn Goodman, by His Honor Judge Edward Hess in his judgment following her court battle with England and Manchester City star, Kyle Walker, brings to light the ‘difficult, unreasonable and demanding’ approaches often taken in cases related to providing financial provision for children where the parents are unmarried. This judgment, due to those involved, has sparked conversations about the financial consequences of having children when unmarried, and will no doubt have an influence within the private family law world on the approach taken within cases of this nature in the future. If you are finding yourself with shared custody of your children, here are some key things to consider so you can optimize time with your kids: - Keep it simple. Lunch dates and intentional conversations about what is going on in their lives can carry more weight than extravagant trips or events. - Remain undistracted. Putting away your phone and not fielding work calls during your time with your kids will make them feel as though they are important, especially as their lives are changing. - Avoid venting. Share your feelings with others in your support system–friends, other adults in your family, or a therapist–but not your children. Do not put them in the middle of any conflicts you may have related to the separation. - Be consistent. Establish rules that are implemented in both parents’ homes. Concrete guidelines for things like homework, curfews, bedtimes, and bad behavior will provide stability for your children. - Develop a shared interest. Having shared experiences with your kids will help build your relationship and establish memories that will last a lifetime. Let's explore two instances of Kyra's Law: 1. **New York's Kyra's Law**: - In New York, Kyra's Law was introduced to enhance child custody proceedings and safeguard children in family court. It aims to address concerns related to child custody and legal custodianship. - Senator **Joseph P. Addabbo Jr.** co-sponsored legislation to establish Kyra's Law, emphasizing the importance of protecting children in domestic violence situations¹. - The law seeks to create a safer environment for children by considering their well-being during family court proceedings. - Advocates and leaders rallied in support of Kyra's Law, recognizing its potential impact on child custody decisions¹. 2. **Max and Keira's Law (United Kingdom)**: - In the United Kingdom, the Organ Donation Act, known as **Max and Keira's Law**, was passed in honor of a boy named Max who received a heart transplant and a girl named Keira who selflessly donated her heart. - This law changes the default organ donation system, making adults in England potential donors unless they explicitly opt out or are excluded. It encourages organ donation to save lives². 3. **Keira's Law (Canada)**: - In Canada, **Keira's Law** (Bill C-233) addresses intimate partner violence. - Following amendments to the Divorce Act, family law judges now consider any history of domestic violence when making determinations about parenting and access to children. - Advocates believe that Keira's Law could have prevented incidents like the alleged abduction of a Saskatchewan girl³. Let's talk about something that can really rub lawyers the wrong way - contempt of court. I've seen judges take all sorts of different approaches when it comes to parties violating their orders. Some will absolutely flip their lid if even the tiniest detail is disobeyed. But most of the time? They seem to barely bat an eye, despite clear violations. If you're considering filing for contempt against your ex or co-parent, there are two key things to keep in mind: 1⃣ The violation needs to directly impact the core issues - the best interests of your children, the division of marital property/assets, finances, etc. Don't waste the court's time over minor infractions. 2⃣ You need to establish a pattern. One missed visit or late payment could be a one-off. But if the behavior continues despite your requests to stop, you're building a stronger case for contempt. 👉 Here's the thing - going the contempt route can easily backfire if you don't have a legitimate, impactful violation clearly documented. The judge may see it as a petty power play, which won't do you any favors. But in certain cases, seeking a contempt order is the only way to enforce the original ruling and protect your rights (or your children's rights). Just be strategic and make sure you're on solid ground first. As with any part of this journey, having the right advisor by your side is crucial. Judges need more guidance, parties need to be forewarned, the system should be altered.
