Helpful update in the FRJ. Recently we’ve seen a string of cases where prenuptial agreements have been upheld, reinforcing the principle that agreements made fairly and transparently will likely stand. In the recent case HJB v WPB [2024], this trend extended to a separation agreement—demonstrating that courts value agreements as long as they meet standards of fairness and disclosure. HJB v WPB shows that challenging these agreements often requires significant grounds, such as proof of unfairness or nondisclosure. For practitioners, this case adds clarity to the enforceability of agreements in family law. The message is clear: courts will consider, and lean towards upholding, agreements made in good faith, whether they’re pre-nups or separation terms. https://lnkd.in/e5wSXXNn
