The Federal Energy Regulatory Commission (FERC) announced a rule yesterday that will require transmission providers to develop 20-year regional plans and figure out how to pay for those projects. State entities will also have to agree to the project scope and cost allocation before proposed projects can move forward. ⚡ In the climate advocacy community, we like the rule. It's a long-overdue step in the right direction. However, it's worth pointing out that this is a contentious rule, with FERC receiving almost 30,000 pages❗in comments since the initial proposal in 2022. That's an agency record for public feedback. A few things I'm curious about: 🤔 1) Will the rule withstand legal pressure? The Major Questions Doctrine is a real threat here, and whether or not it makes it to the Supreme Court will depend on where any challenges land in the circuit courts. 2) What will happen when states refuse to allow regional transmission projects to enter their territory and/or refuse to pay for it? It's all well and good to say states will be meaningfully engaged, but what happens when they don't agree? 3) How will environmental justice communities be engaged? There was a nod to this in yesterday's press conference, but it sounds like we'll have to wait for the full 1,300 pages of rule text to find out more. Based on my conversations yesterday, few people outside of climate policy nerdom understand transmission policy, or what FERC is. 🤓 But we need to start having the conversation. 💡 Modernizing the grid is a critical part of the equation that is often overlooked. Without innovative transmission projects and collaboration across state lines, historic investments in clean energy will not realize their full potential and we won't come close to meeting decarbonization goals. In October I attended the #thoughtLeadersSummitTransitioningtonetzero at this event I listen to leaders in the engery sector speak about the progress, challenges and needs for innovation and funding in Solar, Hydro and Wind energy.I was most intrigued however by 2 things. 1)The grids inability to accommodate these new energy forms at the rate necessary for realistic development. 2)The backlog of planning permissions for these projects. It weirdly reminded me of regulators/the law struggling to regulate social media. I wonder, I wonder 🤔 If it is time for Governments to make a conscious effort to employ a more modern and forward looking approach for the new Technologies they are encouraging ? What would that look like? Could it be a "Department of Government Efficiency (Doge)"? I guess we will have data on this by this time next year? Should the approach be modern problems require modern solutions? or Should it be There is nothing new under the sun we have done this before?
