The Fair Work Commission's President, Justice Hatcher, has issued a statement detailing a draft "right to disconnect" term for all modern awards, mandated by the Fair Work Legislation Amendment (Closing Loopholes No. 2) Act 2024. This term must be included in all modern awards by 26 August 2024, with guidelines to follow. The draft clause allows employees to refuse work-related communications outside their working hours unless it is unreasonable to do so, with exceptions for legal requirements and emergencies. Employers cannot prevent this right, except in specific cases like standby duty or emergency roster changes. The term will be effective from 26 August 2024 for most employers, with small businesses given until 26 August 2025 to comply. Interested parties can comment on the draft by 12 noon (AEST) on Thursday, 1 August 2024, via awards@fwc.gov.au, with comments published on the FWC's website. #fairwork #righttodisconnect

The Fair Work Commission has released its much anticipated draft wording to insert into all modern Awards regarding the right to disconnect. The right to disconnect will be a formal workplace right which allows employees to disconnect from work outside of their ordinary and usual work hours. The changes commence on 26 August 2024 for non small business employers and 26 August 2025 for small business employers. 'The Right to Disconnect' for employees starts from 26 August 2024 🚫 This is one of the key changes under the Fair Work Legislation Amendment (Closing Loopholes) Act 2023 starts from 26 August 2024 for businesses that employ more than 15 employees. For employers that employ less than 15 employees this key change will start from 26 August 2025. This means that eligible employees (covered by the Fair Work System including award and enterprise agreement free employees) will be given a new ‘right to disconnect’ outside of work hours.

NEWS ARTICLE | THE RIGHT TO DISCONNECT BECOMES LAW Employees will have the right to disconnect from work outside normal working hours, after amendments to the Fair Work Act 2009 (Cth) were recently passed. Importantly, nothing in the new law suggests that an employer cannot contact an employee outside of their normal working hours. Rather, the amendments mean employees may refuse to monitor, read or respond to contact, or attempted contact, from an employer or third party outside of the employee’s working hours unless the refusal is unreasonable.
