The Division I Board of Directors ratified new rules allowing schools to help student-athletes secure deals with third parties. Student-athletes retain control over their name, image, and likeness (NIL) agreements. Starting August 1, 2024 schools can provide additional NIL-related support only to athletes who disclose their arrangements. Additionally, student-athletes meeting academic eligibility criteria can transfer immediately without penalty, including undergraduates leaving in good standing and graduate students earning degrees before transferring. The impact on state laws regarding NIL rights varies. Some states have already implemented NIL legislation, allowing student-athletes to profit from their likeness. However, the new Division I rules provide a standardized framework across all member schools, potentially superseding or aligning with existing state laws. The new rules could provide consistency in current NIL regulations. However, navigating nuances may still exist, especially in states with unique or conflicting NIL laws.

So here's an exciting outreach initiative from the USPTO. We are launching a free new initiative to help guide and educate members of the public—from independent inventors to small businesses to large corporations and more—on PTAB proceedings. Volunteers are available to meet with you one-on-one at no cost to answer questions about ex parte appeals and America Invents Act (AIA) proceedings. Specifically, former PTAB judges who are members of the Association of American Patent Judges will answer questions and help provide guidance on PTAB proceedings, including examiner rejections of patent applications (called “ex parte appeals”) and PTAB reviews of challenges to issued patent claims (called “AIA proceedings”). If you’ve received a final rejection of your patent application and are thinking of filing an appeal to the PTAB, someone has challenged claims in your issued patent, or you are considering challenging claims in an issued patent, this Education Clinic is for you.
