One of ISLA’s core ways of working is through building partnerships for social change. As a part of this work, we entered into a strategic partnership with Cliffe Dekker Hofmeyr Inc to establish a working relationship through which we look to advance the mutual work we do on strategic litigation and related matters. As a part of this work, we are excited to share that today CDH will be hosting the #NotFitForPurpose Campaign and other key stakeholders in a pertinent round table discussion on the National Council on Gender Based Violence and Femicide Act. What is the National Council on GBVF Act? The NCGBVF Act is the legal framework through which the state fulfils its obligation to establish effective institutional mechanisms to address GBVF, in line with the State’s substantive obligations to protect all women and gender non-conforming persons from GBVF. The NCGBVF should have been enacted in line with the NSP on GBVF, which provides a comprehensive multi-sectoral, coherent strategic policy and comprehensive framework to guide the substantive provisions of the establishment of such effective institutional mechanisms. The Act was intended to set up a robust framework to combat GBV in South Africa, however critical gaps from the National Strategic Plan were omitted which will weaken the Council’s capacity to achieve its intended goals. Why Reject the Act? Key features are excluded from the Act such as: the exclusion of a funding framework for the implementation of the National Strategic Plan on GBVF; a lack of accountability measures and coordination of the response to GBV; diminished leadership and exclusion of the Presidency as Champion in fighting GBV; reduced representation of CSOs in the Council; lack of local and provincial structures; removal of the Inter-Ministerial Committee; and a weak regulatory framework and absence of timelines. The upshot of these omissions from the Act is that it establishes a National Council on GBV that is unable to effectively combat GBV and is ultimately #NotFitForPurpose. The Roundtable Discussion The Roundtable Discussion will bring together multi-sectoral partners to identify a comprehensive strategic response and effort to hold the government accountable and rejecting the National Council on GBV Act.
