IBBI has come up with a discussion paper on pre-litigation mediation for Operational Creditors under IBC Regime. This would have it own advantages and may come with some teething issues. Many practical hurdles exist as on date with respect to voluntary mediation prior to filing Section 9 Petition or for that matter issuing a demand notice under Section 8 of IBC. It would be a whole new process and as an IBC enthusiast, I cannot wait but to dive deep into this new approach. Finally, the thin line between recovery and revival would be put to a huge test under this new mechanism, if implemented. #ABPost No. 320 #ABLegal
