Hot off the press of our last post regarding employment changes, it has been confirmed that with effect from 26th October 2024 employers must take reasonable steps to prevent sexual harassment of their workers, including by third parties. In essence, employers must be proactive in assessing risk, identifying action and regularly review their processes. There will be clear obligations on employers to comply with the law. The way this can be evidenced is by: * Developing and communicating a robust anti-harassment policy, which includes third party sexual harassment * Undertaking regular risk assessments to identify where sexual harassment may occur and the preventative steps that will be taken to minimise risk. * Being proactively aware of what is happening in your workplace and any warning signs, by engaging with staff through 1-2-1s, appraisals, surveys and exit interviews. * Monitoring and evaluating the effectiveness of these actions. As mentioned previously, this is just the first in a long line of changes which, if made in Labours first 100 days, takes us to 12th October. I anticipate the next few weeks to be busy! While attending a Workers' Comp conference a couple of weeks ago, I learned just how costly some of these claims can be. I wanted to share some tips employers can use to reduce these risks by implementing strategic measures during the hiring process and beyond. Pre-employment screenings, such as health assessments and aptitude tests, help identify candidates who may be prone to injuries or lack the necessary physical capabilities, filtering out high-risk individuals early. I-9 verifications are essential to ensure a legally authorized workforce, reducing legal risks and reinforcing compliance. Conducting post-offer physicals further prevents injuries by confirming that candidates can meet the physical demands of their roles, especially in physically demanding jobs. Thorough background checks are also crucial, uncovering any past behavior that could indicate a higher risk of unsafe conduct in the workplace. This helps employers make informed decisions and maintain a safer work environment. Beyond hiring, upskilling and reskilling employees can significantly reduce workplace injuries. Continuous training in safety protocols, proper equipment usage, and best practices ensures that employees are well-prepared and capable of performing their roles safely. Reskilling can also help align employees' abilities with job requirements, further minimizing injury risks.
