The #USPTO provided new subject matter #eligibility guidance on #AI-related #inventions, effective starting today. The guidance includes new patent eligibility examples (47-49) - the first new set of examples that the Office has provided since 2019. The examples illustrate what is and isn’t patent eligible in uses of AI models to (1) detect anomalies in network traffic, to (2) separate speech from background noise, and to (3) personalize medical treatment. All three new examples show paths to patent eligibility based on incorporation into a practical application, with the USPTO placing significant importance on highlighting technical improvements over existing technologies, and leveraging the specification to do so. More guidance (and patent eligibility examples in particular) is very welcome in this important field of technology, and should lead to more consistency and predictability in how patent eligibility rules will be applied. Today, the USPTO released new patent eligibility guidance for AI inventions. Importantly, the USPTO explained that "many claims to AI inventions are eligible as improvements to the functioning of a computer or improvements to another technology or technical field." The #USPTO has issued #AI subject matter eligibility guidance The U.S. Patent and Trademark Office (USPTO) has issued a guidance update on #patent subject matter eligibility to address #innovation in critical and emerging technologies, including in #artificialintelligence (AI). This guidance took effect on July 17, 2024. It builds on previous guidance by providing further clarity and consistency to how the USPTO and applicants should evaluate subject matter eligibility of claims in patent applications and patents involving inventions related to AI #technology. This update also announces a new set of examples that are intended to assist USPTO personnel in applying the USPTO's subject matter eligibility guidance to AI inventions during patent examination, appeal, and post-grant proceedings. The guidance update is designed to assist USPTO personnel and stakeholders in evaluating the subject matter eligibility of claims in patent applications and patents involving AI #inventions. This guidance update addresses the subject matter eligibility of AI-assisted inventions, which are inventions created by natural persons using one or more AI systems. Under the guidance, AI-assisted inventions are not categorically unpatentable and where one or more persons made a significant contribution to the claimed invention, protection may be sought for AI-assisted inventions. How an invention is developed is not relevant to the subject matter eligibility inquiry. Instead, the inquiry should focus on the claimed invention itself and whether it is the type of innovation eligible for patenting.
