Firms with strong hashtag IP expertise, such as Bird & Bird and Taylor Wessing, have reported rising profits and highlighted the role of high-profile IP disputes and hires in achieving that growth. In Miami, law firms are leading the return-to-office efforts, demonstrating a 97% increase in office attendance since August of last year according to Avison Young | US's Office Busyness Index. "One of the things we've seen is that law firms have come back first and foremost just because attorneys have to learn and be mentored, which is hard to do over Zoom," said Avison Young's Jason Steele. "Law firms have always been leading, but something about the last 12 months shows that it's really just taken off." We got a notable precedential decision today from the Federal Circuit in Dragon IP v. DISH, an appeal that answered two questions that come up at least somewhat often: 1. Can a prevailing party in a patent suit recover attorney's fees under Section 285 from a law firm where the law firm's client is a thinly capitalized LLC created for the sole purpose of filing a lawsuit or handful of suits? 2. Can that same prevailing party recover fees for cost incurred challenging a patent's validity through the IPR process at the PTAB? The panel (C.J. Moore writing for the majority) answered both questions no. Judge Bencivengo dissented but only as to the second question, saying a categorical rule against IPR fees gets the result wrong for DISH and other potential parties and district court judges should get some discretion in this area. (Bencivengo is herself a district court judge who's heard a bunch of patent cases, and she was sitting on the panel by designation) I'm, of course, curious to see if DISH pushes for en banc or Supreme Court review. My instinct is to say that's got to turn on their read on chances of winning a reversal on Question 1; winning on Question 2, only to not be able to collect from a "judgment proof plaintiff," is almost certainly a tough result for most clients. https://lnkd.in/ec5sTWue
