Last week, Manitoba agreed to pay $530 million to children in the care of Manitoba’s child and family services (CFS) agencies to resolve a long running dispute over the Children's Special Allowance (CSA). The CSA is a federal benefit paid to CFS agencies that is to be used for the care, education, training, and advancement of children in care. For 14 years, Manitoba forced CFS agencies to pay over $335 million in CSA benefits to Manitoba, leaving the agencies grossly underfunded and depriving vulnerable children of much-needed resources. In 2022, the Manitoba Court of King’s Bench declared Manitoba’s actions unconstitutional. Three class actions were subsequently commenced to recover damages for the children affected by Manitoba's action, including a class action specifically for children in the care of Métis CFS agencies. The settlement with Manitoba, once approved by the Court, will settle all three class actions. Niklas Holmberg and I, together with Murray Trachtenberg and Genevieve Y. Benoit, had the great privilege to act for the plaintiffs in the Métis CFS agencies class action – the representative plaintiffs, René Lafontaine and Mary Derendorf; the Métis CFS agencies, Métis Child, Family and Community Services and Michif Child & Family Services; and the Métis Child and Family Services Authority. The Métis CFS Agencies and the Métis Authority operate under the auspices of the Manitoba Métis Federation, the national government of the Red River Métis. $84,800,000 will be paid to settle the Métis CFS agencies class action. It is an outstanding result that holds Manitoba accountable for a truly egregious course of conduct, and that will provide meaningful compensation for some of the most vulnerable members of society. I'm heartbroken! On a day I spent talking to people in prison serving long sentences, I returned to Croydon to witness a stabbing with one young man fighting for his life and another in handcuffs. I love Croydon but now I have decided that I 💯% will sell up and move out of Croydon before my children become teenagers.
