This Supreme Court order was made in the case of a female Asstt Professor working with Himachal Pradesh state govt, wherein she was denied Child care leave to take care of her specially abled child as such provision was not adopted in the leave rules of that state government. She had demanded that state govt need to notify provisions similar to Central Civil (Leave) rules of 1972. Many state govt already has such rules. It is worthy to note here that Central government through UGC does funding to the tune of 75% to many state universities. So, deviation in state rules from central rules in case of universities is mere a lack of some paperwork from the side of state govt. SC tried to set it right. P.S. We need to know exact case law to learn the basis of a judgement.

Good News from the Supreme Court! The Supreme Court has upheld the Maharashtra High Court judgment, declaring that the restriction preventing children from applying to private schools under the RTE if they live within 1 km of a government school is invalid, illegal, and has been quashed. This very constraint was successfully challenged and quashed in Uttar Pradesh back in 2015-16 through a landmark judgment by the Allahabad High Court, in which we played a key role. It’s heartening to see the precedent set by the Allahabad High Court being used to protect the rights of children in other states. The impact of our work in UP has contributed to this broader success, ensuring that more children across the country have access to quality education. The Allahabad High Court ruled Friday that the Uttar Pradesh Board of Madarsa Education Act, 2004, is "unconstitutional" and violates the principle of secularism, and ordered the state government to accommodate current students in the formal schooling system. A division bench of the Lucknow bench, comprising Justice Vivek Chaudhary and Justice Subhash Vidyarthi, declared the law ultra vires in response to a writ petition filed by Anshuman Singh Rathore.

It’s unfortunate that despite such advancements, the already capitalistic private educational market will ensure such kids are never given an opportunity in the world of education. The real question is, Is it really about Education anymore? While I agree that the Matriculation system has its own set of demerits and requires a massive reevaluation within its examination system, the bigger question is about how, for some, Matriculation isn’t a choice, it is the only option available. Is the Education system then really providing a platform for everyone ‘equally’? Or is it just an opportunity for the financially sound to continue to monopolise the market? The real dilemma therefore is Merit vs Money.
