Can you believe it’s already time to start thinking about Back-to-School? But before you get too busy shopping for supplies, (which, as you’ll soon read, I can help with), I want to tell you about the secret most parents don't know and why Back-to-School is THE MOST important time for you to think about your family's future. If something happens to you (like an accident) and you are unable to care for your children (either because you are in the hospital or you've passed away) your kids could be taken into protective custody (foster care) until the police can figure out who has legal authority to take care of them. Surprised? You see, the people who spend time with your kids on a daily basis, like relatives, neighbors, or teachers, don’t automatically have the authority to take care of your kids if you can't. Their authority has to be documented legally by you first or a judge will decide. To make sure your kids are not taken into the care of strangers, even for a minute, you need to set up a comprehensive Kids Protection Plan® that names both long-term and short-term legal guardians for your kids, AND ensures they’ll never be in the care of strangers, or anyone you don’t want. AND you must put in place a comprehensive estate plan to ensure your assets are immediately and privately available for your children’s care. As with anything on behalf of your loved ones, gifting should always be in their best interests. Even though your loved ones lack capacity, they still need to be consulted and included as much as possible. Gifts must be reasonable, affordable, and proportionate. When deciding whether to gift you should consider the relationship between the person and who the gift is for, and any previous gifts made. If you are considering making a sizable gift or something out of the ordinary – additional authority may be needed from the Court of Protection. If you are unsure, we can help you make sure the decision is the right one and you have authority. In a field of work where it is tough to start conversations with attorneys who don't know me from Adam, I have found the best method in building trust is to approach my outreach with a "giving" mentality. The same should apply to your intake systems, referral relationships, or building a team culture in your law firm. Find ways to give your time or provide value. Here's a few ideas: 1) Mail a helpful book about _____ that you've recently found insightful with an attorney you've been meaning to connect with. 2) Write a handwritten note to your office staff members with a small gift card to their favorite restaurant or coffee shop. 3) Personally call 5 random people who did not sign up with your firm for their case last month, and thank them for their consideration.
