Retrenchment and the Reskilling Initiative: Industrial Relations Code, 2020 Retrenchment is the termination of employment by an employer for reasons other than voluntary retirement, superannuation, illness, the expiry of a fixed-term contract, or disciplinary action. For employees categorized as "workmen" under the law and with at least one year of service, the process involves several key steps: 1️⃣ Notice or Wages in Lieu: One month’s written notice with reasons for retrenchment or wages in lieu of notice. 2️⃣ Compensation: Equivalent to 15 days of average pay for each completed year of continuous service. 3️⃣ Government Notice: Notification in Form IX to the appropriate government authority, now made easier with email compliance under the Industrial Relations Code. A significant step forward is the Central Government’s Reskilling Fund Initiative: 📌 Employers must transfer an amount equivalent to 15 days of the worker’s last drawn wages to a government-designated account within 10 days of retrenchment. 📌 These funds are distributed to retrenched workers within 45 days to support their reskilling efforts. #retrenchment #employmentlaw #industrialrelations #workforce #reskilling #employeecompensation #compliance #humanresources #hrpolicies #employeerights #workplacelaw #samvidhaan
