When dealing with asbestos in various settings, understanding the definitions and requirements set by the EPA and OSHA is crucial for ensuring safety and compliance. Both agencies address asbestos, but their approaches and terminology differ slightly. The Environmental Protection Agency (EPA) defines Regulated Asbestos-Containing Materials (RACM) as materials containing more than 1% asbestos that are subject to specific regulations under the Asbestos Hazard Emergency Response Act (AHERA). RACM includes any asbestos-containing materials that are being removed, encapsulated, or repaired. The EPA’s regulations focus primarily on managing and disposing of these materials to prevent exposure and environmental contamination. In contrast, the Occupational Safety and Health Administration (OSHA) uses the term... Read the full article here:

🚧 Categorizing Major and Minor Oil Spills on Construction Sites: What OSHA and ASTM Guidelines Say 🛢️ Oil spills on construction sites can range from small drips to large-scale disasters. Knowing how to categorize spills based on volume is critical for effective response and compliance with industry standards. Here's a quick guide on categorizing spills, with reference to OSHA and ASTM guidelines: 1. Minor Spills 🔸 Volume: Generally less than 5 gallons (19 liters). Some guidelines may allow up to 10 gallons (38 liters) for manageable spills. 🔸 OSHA Reference: According to OSHA 29 CFR 1910.120, spills that are small enough to be cleaned up with basic spill kits are typically categorized as minor and don't require external reporting or specialized response teams. 🔸 Examples: Small machinery leaks. Accidental fuel or oil drips during refueling. Container overflows or equipment malfunctions. 🔸 Response: Easily contained with absorbent pads, booms, or spill kits. Quick cleanup without significant risk to the environment or workers. 2. Major Spills 🔸 Volume: Spills greater than 5 gallons (19 liters), with some guidelines considering spills over 50 gallons (190 liters) as major, especially when there’s environmental risk. 🔸 ASTM Reference: The ASTM F1726-12 standard defines major spills as those that significantly exceed containment capabilities and require coordinated, immediate response and reporting. 🔸 Examples: Fuel tank ruptures or significant leaks from heavy machinery. Large-scale spills during fuel transfers or bulk deliveries. Leaks from storage tanks that affect surrounding areas. 🔸 Response: Requires rapid containment and often third-party emergency response teams. Must be reported to OSHA and relevant local environmental authorities, as per OSHA 29 CFR 1910.120 and EPA regulations. Why Categorization Matters By categorizing spills based on volume, construction sites can: ✅ Ensure the appropriate response and resources are deployed. ✅ Comply with OSHA and ASTM standards for safety and environmental protection. ✅ Reduce the risk of environmental contamination and fines. ✅ Protect worker safety and minimize operational downtime. Key Takeaway: Every construction site should have a Spill Response Plan that aligns with OSHA and ASTM guidelines to ensure quick, efficient responses to both minor and major spills. #ConstructionSafety #OilSpillManagement #OSHA #ASTM #EnvironmentalProtection #SpillResponse #Compliance

This article brings to mind a few questions. Did the EPA or the VADEQ follow up on the inspection results? Is so, they were all fixed satisfactorily, correct? If not, was the entity fined? If not, why? It’s one thing to call it out, but if our governing bodies refuse to ensure the laws and regulations are followed, then no one will take them seriously. Obviously a facility this size has a regular PM schedule. Were those PMs being falsified? This issue goes much deeper than a power failure. This is another great example of why we hire Environmental Specialists and Safety Specialists to our teams, and why we listen to them. Also, a good manager or engineer would never let there plant look like this.

Understanding ACP5 Forms and Asbestos Regulations in NYC For any construction or renovation project in New York City, obtaining an ACP5 form is a critical step. This document, required by the NYC Department of Buildings (DOB) and NYC Department of Environmental Protection (DEP), certifies that asbestos is either absent or present in quantities below regulatory thresholds. Without it, securing building permits is not possible. Only NYC DEP-certified Asbestos Investigators are authorized to perform asbestos surveys. Obtaining this certification is a rigorous process that requires documented education, professional experience, and extensive training. The licensing process ensures that only highly qualified professionals assess asbestos risks, helping to protect workers, building occupants, and the environment. At MKM Environmental, we provide asbestos investigation services, including ACP5 compliance, ensuring that projects meet all regulatory and safety requirements. Our team is highly trained and experienced in handling asbestos surveys efficiently and in full compliance with city and state regulations. #NYCConstruction #AsbestosInspection #ACP5 #EnvironmentalCompliance #MKMEnvironmental #BuildingSafety #AsbestosRegulations #RenovationNYC #ACP5Forms
