Research Handbook on Environmental, Social and Corporate Governance, which is edited by Thilo Kuntz and published by Edward Elgar, has just hit the book stands - congratulations Thilo! Monash Law CLARS member, Tim Bowley, and I contributed a chapter on 'Stewardship Codes, ESG Activism and Transnational Ordering' for the book. Using the 2020 example of environmental activism at ExxonMobil as our starting point, Tim and I explore the common belief that the confrontation at ExxonMobil was an isolated example of institutional investors using their leverage to prompt their investee companies to address ESG issues. Our analysis in the chapter shows that, in fact, this kind of activism is increasingly common in markets throughout the world, including developing countries. This evening, I had the opportunity to attend an insightful talk hosted by The Legal Check and Burges Salmon LLP centered around ‘ESG and the law.’ The discussion offered a deep dive into how Environmental, Social, and Governance (ESG) factors impact different areas of law and how overlapping ESG requirements are managed across jurisdictions. This conversation was particularly relevant to my personal interest in how public law mechanisms are being leveraged to enforce environmental practices through corporate initiatives. As someone with involvement in ETG energitechgrin a company driven by sustainability, this topic holds special significance. ETG energitechgrin has been at the forefront of eco-conscious initiatives, integrating sustainable practices across its operations. Through rigorous market research and data-driven strategies, ETG energitechgrin has not only expanded its market but also contributed to reducing environmental impact by adopting cleaner technologies and sustainable business models. Public law frameworks are increasingly being used to ensure businesses prioritize environmental stewardship, pushing forward initiatives that align with both legal obligations and the global urgency for sustainability. This is especially relevant as we approach key environmental deadlines in 2030 and 2050, where both corporate and legal frameworks must work in tandem to achieve meaningful change. Moreover, with Brexit reshaping UK ESG regulations, there is significant potential for a stronger focus on environmental factors in upcoming legal frameworks. Companies committed to sustainability, will likely be crucial players in this shift, showcasing how corporate initiatives can harmonize with public law mechanisms to foster long-term environmental sustainability. After the talk, I had the pleasure of connecting with Burges Salmon LLP graduate recruitment team and current trainees, learning more about the firm’s application process and its commitment to fostering a collaborative and growth-driven culture. I would like to thank everyone involved in organizing such an engaging and informative event.
