Section 108(3) of the 1996 Act provides that a compliant construction contract shall provide “. . . that the decision of the adjudicator is binding until the dispute is finally determined by legal proceedings, by arbitration . . . or by agreement.” The same is provided for in paragraph 23 of the Scheme. What Sudlows says is, at the risk of oversimplifying: (1)   Under the Construction Act, an adjudicator does not have jurisdiction to decide on a dispute which had already been decided in a prior adjudication. (2)   “Whether one dispute is substantially the same as another dispute is a question of fact and degree”. It depends on what happened and what are being disputed. (3)   “One must look at what the first adjudicator actually decided. Ultimately it is what the first adjudicator decided which determines how much or how little remains for consideration by the second adjudicator.” (4)   Even if, for example, the issues in dispute in two adjudications “both concerned time and moreover the same time period”, they may not be substantially the same because a party may have argued it differently and used different evidence (such as an expert report generated after the first adjudication). (5)   It is the decision of the adjudicator that is binding on the parties, not his/her reasoning. However, if the adjudicator’s reasoning or finding was an essential component of or the basis of his/her decision (for example, decision on prolongation costs arising from a finding on the extension of time a contractor is entitled to), that reasoning/finding may also be binding.

The second job of the day yesterday was a greenfield site in Bundamba for Newstart Homes Australia… The team at Reliable Foundations Limited Australia are very experienced with the Biax Foundations system and this slab prep was close to perfection! It just looked beautiful, all the lines were perfect and good use of the Biax 145 pods in the alfresco eliminating the need for the pad to be cut down, allowing the slab mesh to run under into the house slab area.
