Good to see that Herbert Smith Freehills has removed the nasty anti Jewish bigot from its partnership. This episode does throw up questions including: 1. Why did the partnership culture allow this numpty to think that he could be repeatedly openly racist without any fear? 2. Why did no one from the firm pick up on his racism over the past year? 3. Have there been other employees/partners within the firm who have been allowed to be openly racist without anything happening to them? 4. Is this because the firm doesn’t really care or understand about anti Jewish racism? 5. Is it because, as one non Jewish partner indicated to me this week, that the management of the firm ONLY cares about the bottom line and thus allows offices, particularly outside of London, to just get on with everything else, without doing anything to integrate a decent and nurturing culture? 6. Would the firm have thrown out this numpty as quickly as it has done if the firm wasn’t in the midst of taking over a Jewish led New York firm? 7. Has anyone from the leadership team of Kramer Levin spoken to future Jewish colleagues across the Herbert Smith network to learn about their experiences over the last year or so? Maybe a legal publication journalist would like to pose these questions to the Herbert Smith management team? The good news is that in this instance the right decision has been made and anyone who recruits the departing partner will have to explain to the market why they have done so.
