The European Law Institute says that third-party litigation funding should only be subject to regulation in the event of “an identifiable problem or market failure.” Pointing out that funders are already working to what it called “fairly high standards,” the ELI’s recent report, which you can read more about via the below link, also highlights that greater regulation ultimately leads to increased costs of capital and subsequently higher costs of funding. In turn, that could lead to a reduction in funders and funding availability, narrowing opportunities for law firms, and a more difficult pathway to accessing justice for those most in need. The ELI also rightly pointed out that prescriptive regulation is effectively a “one size fits all” approach, and so will not necessarily be suitable across the litigation funding space where there are various contexts and ways to work and a range of approaches to risk mitigation and a host of other factors that are at play. As an alternative to regulation, the ELI report proposed a set of principles supported by suggested minimum content for funding agreements. The publication of this report comes while we still await the Civil Justice Council’s interim report into its review of third-party litigation funding, which was due to be published in the summer, with the final report due in 2025 and likely to inform what happens when the Litigation Funding Agreements (Enforceability) Bill comes back before parliament. As the CJC states, its function is to help make civil justice more accessible, fair, and efficient and that it will consider regulatory options, as well as the efficiency of litigation funding and its role in facilitating access to justice, as part of its review. Interestingly, the ELI project was led by Dame Sara Cockerill, who is part of the CJC’s working group conducting its review, while the ELI project’s advisory committee included Professor Rachael Mulheron, who authored a separate report earlier this year for the Legal Services Board and is part of the CJC’s consultation group. While such panels are, quite rightly, brought together to ensure diversity of experience and viewpoints, it will be interesting in the coming weeks to note the similarities and differences between reports where the same highly influential individuals have been involved. #LitigationFunding #AccessToJustice #FundingRegulation

A Newbie’s Journey into Litigation Every lawyer remembers their "firsts"—the first client, the first court appearance, the first signed deal. For me, another milestone came recently when I made my first appearance as lead counsel in a criminal litigation matter. It wasn’t my first client, but it was my first as lead counsel in any litigation, and especially in criminal law—a world I had, until now, only observed from the safety of the gallery and for some reason made me nervous. I mean me, a whole Jagaban? Lol For the past 10 months, I’ve built a career around corporate practice, sports law, and entertainment law. Negotiating deals and closing transactions felt like second nature, much like Harvey Specter —bringing in results and revenue as a closer. I even jokingly tell people i try to avoid litigation, enthusiastically championing Alternative Dispute Resolution (ADR) at every opportunity. After all, ADR not only aligns with the RPC but also conveniently keeps me away from the courtroom's unpredictability. But the courtroom eventually found me🥲 As I stood there as lead counsel for the first time with no one, the nerves kicked in hereby making me miss the opportunity to announce my appearance—a basic yet vital ritual for any lawyer. Ha! It was a humbling moment when I had to apologize to the court. My Lord laughed but gave an encouraging notion to continue, an awkward but necessary step to correct my oversight. The gravity of standing before a judge, representing a client in a criminal matter, hit me hard. Ngl 🥲 This experience was a far cry from my usual world of corporate practice. In the boardroom, you have time to strategize, polish your drafts, and negotiate at your own pace, I mean I do that with a plate of fries on my table😅. The courtroom, on the other hand, demands immediate confidence, quick thinking, and an almost theatrical presence. As lead counsel, there’s no one to fall back on—it’s your case, your responsibility, and your moment to rise or stumble. This first appearance wasn’t perfect, but it was an important reminder of why lawyers are so often divided over litigation and corporate practice. The courtroom tests your resilience and ability to think on your feet, while corporate practice rewards precision and deal-making prowess, yet both fields are deeply interconnected. A good negotiator often needs the credibility of being a solid litigator, and a skilled litigator benefits from the strategy and foresight honed in corporate practice. While I remain passionate about ADR and corporate practice, my courtroom debut taught me to appreciate the unique demands of litigation. It has definitely strengthened my resolve to grow as a lawyer who can balance both worlds. Because at the end of the day, whether in the boardroom or the courtroom, the ultimate goal is the same: to serve clients with excellence and integrity.
