I watched the 60 Minutes episodes with Lina Khan last night. I appreciate the investigations into prices and unfair competition. Still, it appears that there has been an overwhelming focus on private equity and venture capital industries over the past few years. Meanwhile, one of the most significant costs for the average American is the cost of their health insurance, the deductibles, and the co-insurance. While the FTC has investigated pharmacy benefits managers, why have they ignored the actual health insurance companies that are buying up competitors and reaching monopoly status? Look how the healthcare system was upended this year when Change Healthcare (Purchased by United Healthcare) was hacked. Doctors could not get paid, claims could not be processed, payroll was missed in many practices, and paying rent was at risk. This is the exact reason why I am dedicated to building a first party, bad faith, insurance practice as part of my law practice. Among the many issues that Americans face far too regularly: insurance companies deny claims with absolutely no basis to do so; the fact that vision and dental are somehow treated as separate from one’s health (this is an odd legal fantasy we should not put up with); and finally the fact that both federal and state mental health parity laws are never practically enforced. These and other practices are a result of the lack of regulation and accountability insurance companies are held to. In other words, they have no incentive to do what we pay them to do, since no one is forcing them to do it.
It isn’t just that we are on the verge of ceasing to be a democracy. The fundamental problem in the American culture is that integrity and honesty are no longer considered priorities, and our politics and the illness profit system are perhaps the greatest examples of what we have become.

There is no requirement for employers to pay tax and National Insurance on certain health benefits covered by tax concessions or exemptions. For example, there is no requirement to report employees’ medical or dental treatment or insurance if they are a part of a salary sacrifice arrangement. #MedicalCareEmployees #DentalCareEmployees

It is unbelievable how the legislators favor insurance companies. Well, not really unbelievable. Money talks unfortunately. Insurance is getting to become a simple formality; you have to pay for it, but you really get nothing in return. I totally understand the issues in an area like Southeast Florida where so much fraud and so many dishonest citizens and public adjusters reside, but we are now at a point to whether you either sue the insurance company or you do not get paid. To make things worse, if you WIN your lawsuit, you can't even recover your attorneys fees, so unless you have a 6 figure claim, you might as well just pay out of pocket. How is this fair to any homeowner or Insured? I invite you to read this article I read today. I was a witness to State Farm's tactics to avoid paying for a claim in my own home, so this hit home for me. Something needs to change!
