I often talk to lawyers who are worried about giving up a share of the fee via co-counseling. And while that does happen, we find it to be pretty rare. A more common example is the situation we had at our firm just the other day. Several months ago, an attorney brought us a tough liability case involving an ambulance who t-boned our client on the way to a call. Damages were fairly high but because the ambulance claim it had its lights on, liability was really tough. A defense verdict was a real possibility. The offer was $0 before our co-counsel filed suit. The offer was $0 reasonably deep into litigation. Then we got involved. We were able to negotiate a $335,000 settlement a few months before trial was going to start. The facts didn't change. The law didn't change. But bringing us in changed the risk analysis for the insurance company. And that is what led to settlement. Sure, we took a chunk of the fee. But 50-70% of a large number is more than 100% of a small one and certainly more than 100% of 0. #personalinjuryfirm #triallawyers #cocounsel
