Our Arbitration and Litigation partner Felipe Nazar recently attended the “ESG in Dispute: Rethinking Investor-State Arbitration in a Sustainable World” event organised by the Berkeley Journal of International Law. During the session, Felipe emphasised that “in a sustainable world, investor-state arbitration remains essential for dispute resolution, especially given the absence of a clear replacement”, and went on to highlight its neutrality and adaptability across diverse investments. While acknowledging room for improvement, Felipe cautioned against fixating solely on criticism, urging states to fulfil their duty by establishing clear and enforceable ESG regulations that investors can understand and adhere to. #InvestorStateArbitration #ESG #Sustainability 📷 👇

Arbitration can play an important role in resolving international ESG disputes.   The risk of ESG disputes is now a part of corporate reality, regardless of a company's line of business. Together with Delos Dispute Resolution's Dr. Ghazal Miyar, we discussed these disputes, how to promote sustainability through arbitration and ways to reduce the carbon footprint of arbitration.   Our Dispute Resolution Partners Ilona Karppinen and Jerker Pitkänen, along with ESG Partner Anna Kuusniemi-Laine, highlighted three key points: ✔ Companies should know the regulatory framework for climate change mitigation and sustainability to efficiently manage and allocate risk in commercial contracts. ✔Contracts should also ensure the enforceability of such contractual terms through an appropriate dispute resolution mechanism. International commercial arbitration is well suited for climate change and sustainability disputes arising in the context of contractual relationships and investment treaties. ✔Climate change and sustainability disputes typically include complex regulatory and technical issues, and arbitration proceedings may be tailored to cater to the specific needs of the subject matter. #climatechange #ESG #arbitration #disputeresolution

London International Disputes Week (LIDW) 2024 is underway with a fantastic first panel session on ‘Risk and Reputation in a values driven world.’ Simon Mundy, Financial Times Moral Money Editor, offers some timely advice on how companies should communicate their ESG commitments, including not overstating their green credentials - as we have seen in the past. Shaheed Fatima KC affirms that companies have to consider the public and media perception of any ESG litigation they are involved in. This is often the most pressing concern for company boards in defending ESG claims and highlights the importance of litigation communications in reputation management. #ESG Litigation #Reputation
