New IRS guidance explains how to apply for a 2024 allocation of the environmental justice capacity limitation under the low-income communities bonus energy credit program. 

Recently, a judge for a District Court in Montana held that youth ranging from two to eighteen years old had a "fundamental constitutional right to a clean and healthful environment, which includes climate as part of the environmental life-support system." Congratulations grant recipients! 🎇 The U.S. Environmental Protection Agency (#EPA) selected 38 organizations to receive over $3.6 million through the Environmental Education Grants Program. Organizations with environmental education activities and programs are provided between $50,000 to $100,000. Grantees activities span 28 states and the Republic of Palau, America Samoa, the Commonwealth of the Northern Mariana Islands (#CNMI), and #Guam. For example, in #Palau they're braiding indigenous and western science through youth-led community action to address contamination left behind from World War II. 💡 Stateside, in Milwaukee and Southeast #Wisconsin, they're educating 400 underserved #youth on the impacts of climate change in environmental justice communities, empowering them with indigenous knowledge to combat climate change, take action, and create local solutions. 💡 Learn more about the winners below! 🔽 #youth #environmentaleducation #indigenousknowledge #climatejustice #localsolutions #climatechange #environmentalaction

I can't think of a business that operates in a vacuum, particularly those with environmental or climate impacts. In those worlds, we operate in two regulatory worlds: the compliance and voluntary side. So things a company does because it has to and things it does because it wants to and believe it should do. In the compliance world, the "government" of some kind sets out laws that it expects people to play by. Those laws are then enforced by regulatory agencies of one form or another in accordance with rules. In translating the laws into rules there is a process that is subject to court oversight. Big news in that world is the U.S. Supreme Court's adjustment to that interaction. My Dentons colleagues Clinton Vince, Linda Willard, Sam Olens and Simon Steel in this panel are focussed on: Supreme Court Overturns Chevron Doctrine: Implications for Energy and Climate Policy and Beyond. This significant discussion will have an impact in many other jurisdictions around the world.

TODAY: With broad, bipartisan support, the House of Representatives passed the Abandoned Well Remediation and Development Act (AWRRDA) 👏 which will "fund the research necessary to improve well plugging practices, find unregistered orphan wells in hard-to-reach places like streams, forests, farmland and backyards, and develop beneficial clean energy uses for end-of-life wells," Environmental Defense Fund's Adam Peltz said. This important bipartisan legislation would invest more than $150 million over the next five years to help find an estimated 800,000 undocumented orphan wells, reuse those we can for beneficial purposes and ultimately close the rest more effectively and affordably. ICYMI, last week brought a really bold statement out of the D.C. circuit - a call for a programmatic EIS for the whole Department of Interior fossil fuel program! Cumulative impacts of climate have to be considered more broadly than the existing system allows. "With that said, there is wisdom in the Conservation Groups’ warnings about how the Department of Interior has structured its fossil-fuel program. Climate change is inherently cumulative, yet the various State Offices approve leases independently, on a quarterly basis, according to their own RMPs. That diffuse decision-making structure runs the risk of losing the forest for the trees—and losing the climate battle to the tyranny of small decisions. The Court applauds the Bureau’s efforts to address these structural concerns with its Specialist Report and, partially on that basis, finds no legal error with its analysis here. But given the potentially catastrophic consequences of the climate crisis and the rapidly developing legal and scientific terrain, it may prove prudent for the Bureau to take the next step by preparing a programmatic EIS for the entire federal fossil-fuel program, as the Conservation Groups urge." #climatechange
