Recently, a judge for a District Court in Montana held that youth ranging from two to eighteen years old had a "fundamental constitutional right to a clean and healthful environment, which includes climate as part of the environmental life-support system." Montana's top court ruled that the state's constitution guarantees a right to a stable climate and invalidates laws barring regulators from considering the effects of greenhouse-gas emissions when permitting fossil-fuel projects. The Montana Supreme Court upheld a landmark trial court decision in favor of 16 young people who said their health and futures were being jeopardized by climate change that the state aggravates through its permitting of energy projects. The 6-1 decision, the first of its kind by a U.S. state supreme court, came in the first lawsuit to go to trial nationwide by young environmental activists challenging state and federal policies they say are exacerbating climate change. Can Parliament Save Our Environment? Exploring the New Protection Bill. Instead of capping carbon emissions, the Cook Labor Government has chosen to cap the powers of the Environmental Protection Agency, with the key body being removed from the assessment of future mining and gas projects, under the chairmanship of an industry-approved Chair. This is nothing short of an abandonment of environmental good governance, and yet more proof that both major parties have been bought off by the big end of town. It’s time to consider putting the Liberals and Labor last, if that’s where they’re going to put our grandchildren’s future!

In a victory for the global #climatejustice movement, a South African high court has found that that the government’s decisions to authorise new coal fired power are inconsistent with the Constitution and violate the rights of children and the environmental right. While the judgment is thin on substance, the human rights impacts of new coal fired power in the country, particularly on children, clearly informed the court’s ruling that the government’s decisions to authorise new coal fired power are unlawful. The political pushback against climate change is going to be humanity’s undoing. This is a global problem and that needs cooperative global solutions. As a scientist, it saddens me that there is this kind of pushback against people who have dedicated their careers to science. “ On Dec. 10, 2024, the US Supreme Court will hear oral argument in Seven County Infrastructure Coalition v. Eagle County, Colorado, the first major #NEPA dispute before the court in 20 years. The Supreme Court’s ruling could significantly affect how NEPA applies going forward, especially with respect to #climatechange.” https://lnkd.in/dySnAfXp

This judgment is very good and important for climate justice. I have seen some of the criticisms of this judgment that read into this judgment a strong sentiment that comes down to, "but if the state has to consider how their decisions will affect future generations, then governance will be impossible!" To those sentiments I simply say: perhaps we should rethink how governance works if such a reasonable proposal seems to make governance "impossible". Perhaps a system of governance that prioritises infinite economic growth on a planet with finite resources, needs to think about how these decisions impact future generations...that only seems logical...
