Latest NDIS Commission prosecution announced: "Some of the alleged incidents include failing to provide access to adequately trained support staff, failing to properly manage risks to participants, failing to properly administer medical devices and medication, and failing to properly supervise an adolescent in their care. "The NDIS Commission also alleges [the provider] failed on more than 600 separate occasions to report incidents, including incidents that involved serious injury and neglect, within the required timeframes under law." Please remember that these are allegations only at this stage. INJUSTICE IN THE NSW POLICE FORCE’S TPD CLAIMS PROCESS I act for people making Total and Permanent Disability #TPD claims Last week I wrote a post about changes to the TPD claims process for police officers. In short, police officers who risk their lives and end up permanently disabled may not have access to a lump sum Total and Permanent Disability payment when they need it most. Further to my post last week, we consider it important to note a VERY stringent requirement in making a claim for a #Police #BlueRibbon #TPD entitlement, as it is a detail that appears not to have been communicated in full, especially during this significant time. In making the claim prior to the implementation of the upcoming changes to the new EPS Scheme, you must show that your “Incident Date” occurs prior to 1 October 2024. Your “Incident Date” is determined by the LATER of the date you cease work, OR, a certification date of your injury or Illness which causes your TPD by a “Medical Practitioner”. IMPORTANTLY, if you are claiming for a psychological condition, a “Medical Practitioner” has the further requirement under the policy to have a practicing PSYCHIATRIST make the certification. This is significant, and not often seen in TPD/Group Life policies thorough Superannuation accounts. In the instance that a claimant is only being treated by a GP, and has not been certified unfit to work by a Psychiatrist prior to the change, a claim for the #PBR TPD benefit may experience significant opposition when making the claim with the Insurer. We would urge those contemplating a TPD claim on the PBR cover to seek medical and legal advice immediately. This is a requirement that has been in place on the PBR policy for some time, so may have a wider impact including for those that have already ceased work due to a psychological concern. The deadline to make a claim is fast approaching. I recommend you speak to a lawyer before October to ensure your injuries are covered ahead of time.
