FIFA has introduced an Interim Regulatory Framework for Article 17 RSTP in response to the ECJ ruling in the Diarra case. The interim framework will come into effect on 1 January 2025 and will apply to any pending cases before the FIFA Football Tribunal. 💶 Financial compensation for breach of contract by a player will follow the “positive interest” principle ➡️ the injured party is entitled to be placed in the position they would have been in had the breach not occurred. 📑 Burden of proof is reversed. A new club can only be jointly liable for compensation if the claiming club proves the new club induced the player to breach their contract. Recently, the European Court of Justice ("ECJ") delivered its judgment in the Lassana Diarra case. The ECJ finds that some aspects of FIFA's transfer rules regarding financial compensation and imposing additional sporting sanctions on both club and player in case of early contract termination without "just cause" are incompatible with the guarantee of freedom of movement and EU competition law. As a result, there is a high likelihood that FIFA will be revising the RSTP.
